المستخلص:This study examines the punitive protection of the industrial and commercial ownership rights, particularly the trademarks in the Jordanian law, as a comparative study with TRIPS Treaty. The purpose of the trade mark is to enable the consumer know the products of the companies to distinguish them from other similar ones. In this regard, the consumer may define the goods he desires to purchase of the ones whose use is repeated in the future. Accordingly, he needs an easy mechanism to distinguish the similar products. In general. Any word, letter, figures, drawings, colors, photographs, shapes of a mix of the above said to be used as a means to distinguish the products and services of other companies, which can be considered a trade mark. In order to study the trade mark from a punitive perspective, it is necessary to study the scope of protecting the trade mark from a punitive perspective, know the crimes that are committed against the trade mark and to show the punishments on the ones who commit such crimes. These crimes are: 1- Forgery or imitation of trade mark/s; 2- Using a registered trade mark; 3- Having a comedy with an intention to sell it or to sell a commodity or offer a fraud or an imitated for sale.
