| المستخلص: | All praise is due to Allah alone, the Lord of all Worlds and peace and blessings be upon prophet Mohammed, the Seal of Prophets and Messengers Title: Islamic fundamental applications on the chapter of Hajj in Umdatul Ahkaam Book. Researcher: Faisal Dawood Almuallim, faculty in the College of Sharia and Islamic Studies, Umm Al-Qura University. Research objectives: to highlight the impact of Islamic fundamental bases in understanding Islamic scriptures; to link students of knowledge with the Quran and Sunnah in their jurisprudence (Fiqh); to show the connection between Islamic jurisprudence and its fundamental; to indicate the impact of the dispute in the fundamental bases on their branches; and to serve Hajj issues contributing in guiding pilgrims and visitors and directing them as per the Sunnah of our Prophet Muhammad peace be upon him. Scope of research: selected hadiths from the chapter of Hajj in the book of “Umdatul Ahkaam min Kalaami Khairi al-Anaam”, Imam Al-Hafizh Abdul Ghani Almaqdisi Alhambali, may Allah have mercy on him. Research methodology: 1. I begin by quoting the hadith text with Arabic diacritics from the book and might mention two hadiths for a common link. 2. I limited the research to the applications mentioned by Ibn-Daqeeq Aleid in Alehakam, Ibn Almolaqin in Alea'lam, Alsana'ani in Aleddah, Albassam in Tayseer Alallam and sometimes Alqurtubi in Almufhim. I might state some Islamic fundamental applications that were not mentioned in previous books by contemplating and reflecting in the Hadith seeking more beneficial knowledge. 3. I limited the research to Islamic fundamental bases matters without the Islamic jurisprudence and linguistic matters, but I might mention few related minor points. 4. The research was not intended for extended study about Islamic fundamental matters and their disputes but was intended to demonstrate the way for ruling extraction and the influence of the fundamental base on Islamic scriptures. 5. In some places, I have identified certain terms that need to be known. Research plan: start with an introduction explaining the meaning of “Islamic fundamental applications”, followed by ten examples of selected hadiths from the chapter of Hajj, and finally conclude the research. Research results: A. Most mistakes in ruling extracting are caused by two reasons: first is misunderstanding of fundamental base, and second is wrong implementation of the fundamental base on the practical case. B. The importance of this branch of science which link between jurisprudence and its Islamic fundamental considering Islamic scriptures leading to build a connection between students of knowledge and their jurisprudence for Quran and Sunnah. C. Studying this science show the reasons of differences in preceding Imams point-of views. All praise is due to Allah alone, the Lord of all Worlds and peace be upon our prophet Mohammed and his family and companions. الحمد لله رب العالمين، والصلاة والسلام على خاتم الأنبياء والمرسلين، وبعد: عنوان البحث: تطبيقات أصولية على أحاديث كتاب الحج من عمدة الأحكام. اسم الباحث/ وجهته: فيصل بن داود المعلم، كلية الشريعة والدراسات الإسلامية بجامعة أم القرى. أهداف البحث: إبراز أثر القواعد الأصولية في فهم النصوص الشرعية، وربط طلبة العلم في فقههم بالكتاب والسنة، والربط بين الفقه وأصوله، وبيان أثر الخلاف في القواعد الأصولية على الفروع، خدمة مسائل الحج المساهمة في إرشاد الحجيج والعمَّار وتوجيههم وفق ما تقتضيه سنّة نبيّنا محمد صلى الله عليه وعلى آله وصحبه أجمعين. محل البحث: أحاديث مختارة في باب الحج من كتاب "عمدة الأحكام من كلام خير الأنام" للإمام الحافظ عبد الغني المقدسي الحنبلي -رحمه الله -. منهج البحث: 1. أبدأ بذكر الحديث من عمدة الأحكام كاملا مضبوطا بالشكل، وقد أُردِفُ حديثين لوجود ترابط بين أحكامهما. 2. اقتصرت على التطبيقات التي ذكرها ابن دقيق العيد في الإحكام، وابن الملقن في الإعلام، والصنعاني في العدة، والبسام في تيسير العلام، وقد أرجع إلى القرطبي في المفهِم، وقد أذكر بعض التطبيقات الأصولية التي لم يرد التنبيه عليها في الكتب السابقة من خلال النظر والتأمل في الحديث؛ رغبةً في الفائدة. 3. اقتصرت على ذكر الفوائد، والمسائل الأصولية فقط دون الفقهية أو اللغوية، لكن قد أذكر شيئا من ذلك بإشارات لطيفة سريعة ويكون ذلك تبعاً لا قصدا. 4. ليس المقصود من هذا البحث بسط الكلام على المباحث الأصولية، وذكر الخلاف فيها، ولا إثبات الراجح فيه، وإنما إظهار مأخذ الحكم وأثر القاعدة الأصولية في النص الشرعي، والإشارة إلى طريق الاستنباط. 5. اعتنيت في بعض المواضع بتعريف بعض المصطلحات التي يحتاج إلى معرفتها. خطة البحث: تتلخص خطة البحث في تمهيد لبيان المراد ب "التطبيقات الأصولية"، ثم مبحث تضمن التطبيق على أحاديث من كتاب الحج، فخاتمة ختمت البحث. نتائج البحث: أ. أن أكثر الأخطاء في بناء الأحكام يرجع لسببين، الأول: عدم فهم القاعدة الأصولية واستيعابها. والثاني: الخطأ في تنزيل الوقائع على القواعد الأصولية. ب. ضرورة العناية بهذا الفن الذي يربط بين الفقه وأصوله، ويعتني بالنصوص الشرعية، مما يجعل طلبة العلم مرتبطين في فقههم بالكتاب والسنة. ج. الاعتناء بهذا الفن يورث التماس الأعذار للأئمة السابقين، ويظهر أسباب اختلافهم، ومآخذهم في الأحكام التي ذهبوا إليها. |
