| المستخلص: | The medicine is a science which has a great importance, benefit and status . Its grace has spread and it became very famous . Medicine in its objectives is a mission and a profession in its practice . It is distinct in this regard from the other professions. It has honorable results and many benefits . So we should give it a great care to get good results .\nThe person who contemplates in the contemporary reality finds a great importance of the related issues between the doctor and his patient, especially with regard to medical secrets. Patients reveal their secrets to doctors voluntarily. I have chosen to study this important subject. I entitled it "The Medical Secret, among Doctors and Scholars, An Applied Rooting Study". The most important characteristic of the medical profession is the relationship between the doctor and his patient. The patient tells his doctor his greatest secrets; this should contribute to speedy access to appropriate treatment. The most important topics of the research are as follows :\n1) Definition of medical secret.\n2) The date of the medical secret, its scope, and basis of adhering to it .\n3) Definition of confidentiality, its virtue, and wisdom.\n4) Elements of the crime of disclosure of the medical secret\n5) Ruling of the doctor's disclosure of the medical secret\n6) The penalty of the doctor if the medical secret is disclosed.\n7) Ruling of the repetition of the doctor's disclosure of the medical secret.\n8) Ruling of the disclosure of medical secret by medical staff .\n9) Medical secret in reports and medical prescriptions.\n10) The way by which the doctor tells the patient the nature of his illness.\n11) Forms for medical secret issues.\n12) History of Medicine in Saudi Arabian Kingdom.\n13) Medical secret in the systems of Saudi Arabian Kingdom\nI Concluded the research with the most important results, and proposals.\nThis abstract translated by Dar AlMandumah Inc. 2018 الحمد لله وحده، والصلاة والسلام على من لا نبي بعده.. أما بعد..\nفإن الطب علم جليل القدر، عظيم النفع، عالي المكانة، رفيع المنزلة، فقد انتشر فضله، وعم خيره، وذاع أمره واشتهر، فالطب في أهدافه رسالة، وفي ممارسته مهنة، فهو متميز في هذا المقام عن سائر المهن، فشرف المطلوب بشرف نتائجه، ويعظم خيره بكثرة منافعه، وبحسب منافعه تجب العناية به، وعلى قدر العناية به يكون اجتناء ثمرته.\nوإن المتأمل في الواقع المعاصر يجد أهمية كبرى للقضايا ذات الصلة بين الطبيب ومريضه؛ خاصة ما يتعلق بالأسرار الطبية، فالمرضى يكشفون للأطباء عن خباياهم، ويودعونهم أسرارهم طواعية؛ ثقة في أمانتهم، لذا وقع اختياري على دراسة هذا الموضوع المهم، واخترت له عنواناً: "السر الطبي بين الأطباء والفقهاء دراسة تأصيلية تطبيقية"، لأن أهم ما يميز مهنة الطب علاقة الطبيب بمريضه، فالمريض يقدم لطبيبه أعظم أسراره؛ رجاء أن يسهم ذلك في سرعة الوصول إلى العلاج المناسب له وأهم معالم البحث ما يأتي:\n1)\tتعريف السر الطبي.\n2)\tتاريخ السر الطبي، ونطاقه، وأساس الالتزام به.\n3)\tتعريف كتمان السر، وفضله، وحكمه.\n4)\tأركان جريمة إفشاء السر الطبي\n5)\tحكم إفشاء الطبيب للسر الطبي\n6)\tعقوبة الطبيب إذا أفشى السر الطبي.\n7)\tحكم تكرار إفشاء الطبيب للسر الطبي.\n8)\tحكم إفشاء أفراد الطاقم الطبي للسر الطبي.\n9)\tالسر الطبي في التقارير والوصفات الطبية.\n10)\tكيفية اخبار الطبيب المريض بطبيعة مرضه.\n11)\tنماذج لقضايا السر الطبي.\n12)\tتاريخ الطب في المملكة العربية السعودية.\n13)\tالسر الطبي في أنظمة المملكة العربية السعودية.\nمختتماً البحث بأهم النتائج، والمقترحات.\nومن الله تعالى نستمد العون، والتوفيق، والسداد. |
