| المستخلص: | L’objectif de cette étude est de mettre en exergue le rôle important que revêt l’opération d’inscription des électeurs et d’analyser les critères requis par la loi algérienne en matière d’électorat. Il s’agit de déterminer le corps électoral et non pas une simple formalité d’autant plus que cela constitue un facteur essentiel dans l’orientation des élections et influe directement sur les scrutins. Aussi, les critères de l’opération d’inscription des électeurs et son contrôle doivent-ils être en symbiose avec les droits reconnus par la constitution du pays, obéir aux obligations consacrées dans la Déclaration Universelle des Droits de l’Homme et les différents instruments internationaux relatifs aux droits de l’Homme et enfin mettre à contribution les meilleurs résultats auxquels ont abouti les systèmes comparés à la lumière des pratiques inspirées de la réalité. The aim of this study is to highlight the important role of the voter registration process, and to analyze electorate requirements set up by Algerian law. The fact of the matter is to determine the electoral body and not just a mere formality because it is an essential factor in the orientation of elections, and it has a direct influence on the polls. Therefore, the criteria for voter registration process and its monitoring should be in harmony with the rights enshrined in the country's constitution and the obligations laid down in the Universal Declaration of Human Rights as well as other international instruments related to human rights and with the best results achieved in compared systems in the light of reality-inspired practices. تهدف هذه الدراسة إلى بيان الدور الهام لعملية تسجيل الناخبين وتحليل معايير الانتماء إلى الهيئة الناخبة في القانون الجزائري، وهي مسألة لها علاقة بتحديد حجم الجسم الانتخابي، وعليه فإنها ليست مجرد مسألة شكلية، بل هي عامل أساسي في توجيه الانتخابات، ولها أثر مباشر على نتائجها، لذا يجب أن تكون معايير عملية تسجيل الناخبين منسجمة مع الحقوق المعترف بها في دستور البلاد، ومع الواجبات المحددة في الميثاق العالمي لحقوق الإنسان والمواثيق الدولية الأخرى في مجال حقوق الإنسان، ومستفيدة مما توصلت إليه الأنظمة المقارنة في هذا المجال من خلال الممارسات والتجارب المستمدة من الواقع. |
