| المستخلص: | الحمد لله رب العالمين، رب السماوات السبع ورب العرش العظيم، وصلاة وسلاما على خاتم الأنبياء وسيد المرسلين، نبينا محمد وعلى آله وصحبه أجمعين، وبعد: فإن الحقوق المالية للمطلقة طلاقا بائنا ليست منحة من الرجل، إنما هي حقوق شرعية ثابتة في ماله، لا ينازعها فيها منازع، إلا أنه في هذا الزمن قد تجهل هذه الحقوق أو تجحد؛ لذا كثرت الدعاوى في محاكم الأحوال الشخصية فيما يتعلق بهذا الأمر، وكثير ممن هضمت حقوقهن بعد الطلاق لا تطالب بحقها جهلا منها بهذا الحق؛ ولما كان الأم كما ذكر أحببت أن أسهم يبحث في بيان حقوق المطلقة البائن؛ ليعلم الزوج المطلق أن هذا حق واجب عليه فيسارع لإبراء ذمته منه، وتعلم المطلقة أن لها حقوقا فتطالب بها إن هي منعت تلك الحقوق، وقد قسمت هذا البحث إلى تمهيد وخمسة مباحث: • التمهيد: في بيان مفردات عنوان البحث. • المبحث الأول: حق المطلقة طلاقاً بائنا في المهر. • المبحث الثاني: حق المطلقة طلاقاً بائنا في النفقة والمسكن. • المبحث الثالث: حق المطلقة طلاقاٌ بائنا في المتعة. • المبحث الرابع: حق المطلقة طلاقا بائنا في أجرة الرضاع والحضانة. • المبحث الخامس: حق الطلقة البائن في ميراث الزوج المطلق. وخرجت في ختامه بجملة من النتائج والتوصيات التي آمل أن تكون محققة لشيء من المقصود بهذا البحث، والحمد لله الذي بنعمته تتم الصالحات، والصلاة والسلام على من أتم الله به سلسلة النبوة والرسالات، عليه وعلى آله وصحبه أهل المضل والسبق والفوز بأعلى الدرجات، كما اسأل الله الهداية والرشاد وأن يصلح فساد ذات البين، فإنه نعم المولى ونعم النصير، والحمد لله رب العالمين. financial rights of irrevocably divorced woman. Praise be to Allah, the Lord of the seven heavens and Lord of the Great Throne, and prayers and peace be upon the seal of the prophets and messengers, the Prophet Muhammad and his family and companions, and after: The financial rights of irrevocably divorced woman is not a grant from the man but are legitimate and fixed rights in money undoubtedly. However, at this time these rights may be ignored or denied; therefore proceedings in family courts in relation to this matter became more and more. Many of those their rights have been denied after divorce does not claim its right without knowledge of it. Since the matter was as mentioned, I liked to submit a research to clarify the rights of irrevocably divorced woman to make husband knows that this is a right and a duty upon it and subsequently accelerate in releasing from liability, and the divorced woman learns that her rights to claim it if she is prevented from those rights. I have divided this research into preface and five topics: •Preface: In demonstrating the vocabulary of the thesis title. •The first topic: the right of irrevocably divorced woman in dowry. •The second topic: the right of irrevocably divorced woman in alimony and housing. •The third topic: the right of irrevocably divorced woman in compensation given to her. •The fourth topic: the right of irrevocably divorced woman in nurturing fare. •The fifth topic: the right of irrevocably divorced womanin the inheritance of the divorced husband. I concluded with a set of findings and recommendations which I hope will be realized for something of the meaning of this research, and thank God that His grace is righteousness, peace and prayers to the fullest by God series of prophecy and divine, him and his family and the people of virtue, and the lead and win the highest grades, and Praise be to Allah. |
