| المستخلص: | تناولت الدراسة أهمية رفع مكانه فلسطين إلى صفة دولة مراقب في الأمم المتحدة الذي يعنى تجسيد وجود دولة فلسطين كشخصية قانونية دولية، واعتراف المجتمع الدولي بقدرة فلسطين على تولي مهام دولة، ويسهل الطريق أمام تعزيز السيادة الفلسطينية، والدفع باتجاه الاستقلال، ويجب أن يكون له تأثيره على السلطة الوطنية كدولة. وبينت الدراسة أيضا أنه هناك حاجة لإعادة النظر في النظام السياسي الفلسطيني من مداخل عديدة تقوم على تحقق الوحدة الوطنية والمصالحة، والعمل من أجل تحويل قرار الدولة إلى ممارسة على الأرض، وتحقيق الإصلاح الدستوري الذي يجسد المواءمة بين تحقيق الشرعية الدستورية والمشروعية السياسية، وتبني المواطنة أساس الدولة، وسن قانون الجنسية، وتعديل قانون الانتخابات بما يعزز مبدأ المواطنة المتساوية والولاء الوطني، والحق في المشاركة السياسية لكل فلسطيني أينما وجد، أي أنه يجب أن تصبح دولة فلسطين المانح الوحيد للحقوق والواجبات لكل المواطنين، وأنه يبقى على الدولة مسؤولية تفعيل وتنظيم المواطنة على أساس المساواة في الحقوق والواجبات والمسئوليات، والمشاركة في صنع القرار. The study shows the importance of raising Palestine to the observer status in the united nations, which means the existence of Palestine as international legal figure, the recognition of the international community that Palestine has the ability to takeover the functions of the state, and facilitate the way for the promotion of Palestinian sovereignty and push towards the independence. It must has an impact on the national Authority as a state. Also, the study highlight and point out to the need of the reconsidering the Palestinian political system from different sides based on fulfilling the unity and reconciliation, work hard on transferring the state decisions to apply on the ground, and the achievement of constitutional reform, that embodies the harmonization of achieving constitutional legitimacy and political legitimacy, the adoption of citizenship is the state basis, the enactment of the Nationality Law and the amendment of the Elections Law to promote the principle of equal citizenship and national loyalty, and the right to political participation of every Palestinian wherever it exists. To sum up, the State of Palestine must become the only donor of the rights and duties of all citizens, the responsibility to activate and organize citizenship on the basis of equal rights, duties and responsibilities, and participation in decision-making. |
