| المستخلص: | تتناول هذه الدراسة شروط الحضانة ومسألة إسقاطها في قوانين الأسرة للدول المغاربية، لما للحاضن من أهمية بالغة في تنشئة الطفل المحضون في مجتمع عربي مسلم متكامل، إضافة إلى كونها تمس جيل المستقبل. لذلك فهي تتعلق بحصر وتوضيح هذه الشروط في قوانين الأسرة المغربية، من أجل الوقوف قدر المستطاع على مدى تقارب وتباعد هذه القوانين، وإيجاد الحلول الممكنة لمختلف الإشكاليات التي تطرأ في هذا المجال. وهي دراسة تتيح الفرصة للقارئ للاطلاع على شروط الحضانة والشروط التي يجب توفرها في الحاضن وأسباب سقوطها. This study deals with the conditions of custody and the question of its revoking in the family laws of the Maghreb countries because the custodial person has the great importance in the upbringing of the child subject to the custody in an integrated Arab Muslim society, in addition to it affecting the future generation. It is therefore concerned with limiting and clarifying these requirements in Moroccan family laws in order to determine, as far as possible, the extent of the convergence and divergence of these laws and to find the possible solutions to the various problems that arise in this area. It is a study that provides the reader with the opportunity to learn about the conditions of custody, the conditions that must be met in the person receiving the custody and the reasons for its revocation.\nThis abstract translated by Dar AlMandumah Inc 2018. On aborde à travers cette étude les conditions de la hadana et la question de son annulation dans le droit maghrébin de la famille, cela est dû à l'importance de celui qui est chargé de -la garde- la hadana dans l'éducation de l'enfant dans une société arabo musulmane, En outre, elle est relative à la future génération. C'est pourquoi cetteprésente étude éclaire les conditions de la hadana dans le droit de la famille en pays maghrébins afin de définir les divergences et convergences de ces législations et les solutions possibles pour les différentes problématiques évoquées en ce sens. C'est une étudequi permet au lecteur la compréhension des conditions de la hadana et les causes de son annulation. |
