| المستخلص: | يترتب عن تنفيذ السائح لعقد السياحة والأسفار جملة من الالتزامات التعاقدية في مواجهة الوكالة السياحية بغية تنفيذها لرحلة سياحية هادئة وآمنة. حيث يلتزم السائح بعدم التصرف التام في بنود العقد السياحي إلا إذا وجد شرط صريح يخوله الحق في التنازل عنه، تعديل بنوده أو إلغائها هذا من ناحية، ومن ناحية أخرى يلتزم السائح بتنفيذ البنود التعاقدية وذلك باحترامه لبرنامج الرحلة السياحية المقرر من طرف وكالة السياحة وكذا التزامه بدفع ثمن مختلف الخدمات السياحية، ومجال هذه الدراسة هي التزامات السائح التعاقدية في مواجهة وكالة السياحة والأسفار. En exécutant le contrat de voyage et de tourisme, le touriste a un ensemble d'obligations contractuelles mises par l'agence de tourisme pour avoir un voyage de tourisme quitté et sûr. Le touriste doit être commis pour ne jamais ne disposer dans les conditions de contrat touristique à moins qu'ayant un terme permettant l'octroi de cela, le modifier ou l'annuler. D’une autre coté, le touriste devrait être commis exécutant des termes contractuels en observant le programme de voyage touristique fourni par l'agence de tourisme. En plus, le touriste devrait être commis payant des services touristiques divers. Cette étude est concernée par les obligations contractuelles touristiques faisant face l'agence de tourisme et voyage. The tourist's performance of the tourism and travel contract entails a series of contractual obligations vis-à-vis the tourism agency in order to carry out a peaceful and safe tourist journey. That is as the tourist is obliged not to dispose completely of the terms of the tourism contract unless there is an express condition entitling him to waive, amend or cancel it on the one hand. On the other hand, the tourist is obliged to carry out the contractual terms by respecting the travel program established by the tourism agency and through his commitment to pay for the various tourism services.
