| المستخلص: | من المعروف أن المتهم يتمتع بجملة من الضمانات أثناء محاكمته، منها ما تعلق بالسلطة التي تنظر الدعوى، والتي ينبغي أن تكون مستقلة ومحايدة، ومنها ما تعلق بالمبادئ الأساسية للإجراءات الجنائية كمبدأ الشرعية ومبدأ عدم رجعية القانون الجنائي ومبدأ عدم المحاكمة على ذات الجريمة مرتين. وضمانات أخرى تتعلق بالقواعد الأساسية المنظمة لتلك الإجراءات كمبدأ العلانية في المحاكمة وكذا تدوين إجراءاتها والتقيد بحدودها وبحضور المتهم ذاته. كما أن هناك ضمانات أخرى تتعلق بحق المتهم في الدفاع، وهي ضرورة معاملته على قدم المساواة في الإجراءات الجنائية من قبل السلطة المختصة، وأن يحظى بنفس الحقوق التي يتمتع بها خصمه بعد أن يتم إحاطته علماً بالتهمة المنسوبة إليه ومضمونها، وحقه كذلك في الاستعانة بمحام ومترجم إذا لم متكلماً بلغة المحكمة أو لا يفهمها، إضافةً لحقه في الاستماع إلى الشهود ومسائلتهم، وأخيراً عدم إرغامه للشهادة على نفسه. It is known that the accused has during the trial, several guarantees including those relating to the authority that consider the suit , and which should be independent and impartial, and some of them are related to the basic principles of criminal procedure like the principle of legality , the principle of non-retroactivity of criminal law and the principle of non-prosecution on the same crime twice in a court of law. And other guarantees relating to the basic rules organizing those procedures , like the principle of publicity in the trial , the codification of its procedures, the compliance with its limits with the presence of the same defendant. There are other guarantees concerning to the right of the accused to defense, which relates to the need to treat him equally in criminal proceedings by the competent authority which is that it should be treated equally in criminal proceedings by the competent authority , and to have the same rights as his adversary , after being informed to its accusation and its content , and its right to have a lawyer and an interpreter if he does not speak or understand the language of the court, in addition to its right to listen to the witnesses and accountability, and not forcing him to testify on himself. |
