| المستخلص: | تعتبر برامج الكمبيوتر المبتكرة مصنفات فكرية جديرة بحكاية قوانين حق المؤلف. وترتيباً على ذلك فان المصمم يتمتع بالحق الأدبي منذ اللحظة التي يظهر فيها برنامجه إلى العالم الخارجي بشكل محسوس بحيث يمكن أدراكه بواسطة حواس الأنسان بما يسمح بالكشف عن اللمسة الابتكار الموجودة فيه. وتتحدد خصائص هذا الحق علي ضوء اعتبارين. الأول يتمثل بانه الحق الأدبي لصيق بشخص المصمم فيشترك مع الحقوق اللصيقة بالشخصية في عدم جواز التصرف فيه ولا الحجز عليه. ولا يرد عليه التقادم. أما الثاني فيتجسد بالنظر لاعتبار هذا الحق عنصراً في حق المؤلف. فتكون بعض سلطاته قابلة للانتقال الورثة في حدود معينة. كما أن الحق الأدبي يخول المصمم مجموعة من السلطات تمكنه من حماية شخصيته التي تعبر عنها برنامجه. ويؤكد أبوته على هذا البرنامج. وتكفل احترام هذا البرنامج باعتباره امتداداً لشخصيته. وللمصمم عند الاعتداء علي حقه الأدبي. أن يشرع فوراً في الإجراءات الوقائية المناسبة لوقف ذلك الاعتداء ومنع تفاقم الأضرار. Innovative computer programs considered as intellectual works worthy of the protection of copyright laws, and accordingly, the designer has the moral right from the moment that his program appears to the outside world in such a way that it can be understood by human senses in order to reveal the creative touch in it. In light of the first two considerations, namely, that the moral right to be close to the person of the designer shares with the personal rights of the person not to be disposed of or to be arrested, nor does the statute of limitations apply to him. The second is embodied in the view that this right is an element of copyright. The right of literature entitles the designer to a group of authorities to enable him to protect his personality expressed in his program. His paternity affirms this program and ensures that this program is respected as an extension of his personality and the designer in the attack on his moral right should immediately initiate preventive measures.
