| 520 | |f The aim of this study is to try to find out the characteristics of the contract of sale of real estate on designs. This contract is distinguished from the traditional sale of a property that exists at the time of the contract, where the main obligation is that the salesman of the real estate has to build the sold real estate within a specified period of time.\nTherefore, determining the characteristics of this new contract requires us to examine whether this contract is considered a periodical contract, since the main obligation in it is to build the sold real estate within the period specified in the contract and whether it is a contract of compliance or not, given that the salesman of the real estate is independent of setting the terms.\nThis abstract translated by Dar AlMandumah Inc. 2018 | ||

| 520 | |d Cette étude vise de définir les caractères du contrat de vente d’immeuble sur plans. Le dit contrat se distingue de la vente traditionnelle d’immeuble au moment de la passation du contrat en tant que l’obligation principale y insérée consiste dans la construction par le vendeur promoteur immobilier d’un immeuble pendant une période déterminée.\nAussi, la détermination des caractères du nouveau contrat dont s’agit implique, dans cette recherche, la question de savoir s’il pouvait être regardé comme un contrat temporel, compte tenu, à cet égard, de l’obligation principale précitée et, s’il était ou non d’adhésion des lors que le vendeur promoteur immobilier jouir d’une indépendance dans la fixation de ses conditions. | ||
