| 520 | |a تعتبر الدولة العراقية بمقتضى المادة الأولى من دستورها الصادر عام 2005 دولة فدرالية، وبموجب الدستور ذاته تتكون السلطة التشريعية الاتحادية العراقية من مجلسين، يطلق على المجلس الأول اسم مجلس النواب ويمثل بدوره الشعب العراقي وبمختلف طبقاته، ويدعي المجلس الثاني بمجلس الاتحاد والذي يمثل بدوره الأقاليم والمحافظات غير المنتظمة في إقليم، ويختلف هذين المجلسين بمقتضي قواعد الدستور العراقي من حيث كيفية تكوينهما والاختصاصات المقررة لكل منهما، فالنصوص الواردة في الدستور العراقي قد بين كيفية تكوين مجلس النواب وحدد اختصاصاته وبوضوح، في حين ترك كل ما يتعلق بمجلس الاتحاد من حيث كيفية التنظيم والاختصاصات لمجلس النواب ليقوم الأخير بتنظيم مجلس الاتحاد عن طريق سن قانون لذلك يصدر بموافقة ثلثي أعضاء مجلس النواب، ويعدا هذا الأمر مقارنة بدساتير الدول الفدرالية. كالدستور الأمريكي والألماني والفرنسي. مخالفة صريحة وواضحة للمبادئ الدستورية الأساسية، لأن مسألة تنظيم المجلس الاتحادي وتحديد اختصاصاته تعد من المسائل الواقعة في إطار الاختصاصات الدستورية ولا تقع في نطاق اختصاصات مجلس النواب. وقد أشرنا من خلال هذه الدراسة إلى المعوقات التي تقف حائلا بوجه تكوين مجلس الاتحاد العراقي. | ||
