| المستخلص: | للاستفادة من التقنية الحاسوبية لمساعدة القاضي الجنائي، أتت الحاجة لإيجاد طريقة لمحاكاة لتكوين عقيدة القاضي في القضية، بطريقة يفهما الحاسب الآلي للوصول لقرار الحكم، تم اقتراح ميزان الاستدلال كأداة لقياس قيمة الأدلة بصيغة قيمية، بني النموذج على فكرة وزن وقيمة الدليل، فما يحدده منطق القانون يسمى وزن WEIGHT، وللقاضي حرية التقدير حسب أثر الدليل VALUE على عريضة الاتهام المقدمة، تمت الاستفادة من فكرة حساب جمع الاحتمالات الرياضية؛ فاستخدم الجمع في تجميع الأدلة المؤثرة في الحكم، وأداة ضرب الوزن في قيمته، بحيث لا يستطيع القاضي أن يقدر قيمة للدليل أكبر من وزنه القانوني، كما تم الأخذ بالاعتبار أن قيمة الترجيح لا يتدعى 100%، فمهما كثرة الأدلة الصحيحة المقدمة، فقيمة الأدلة ستتناقص إذا بلغت نصاب الإثبات؛ فما زاد عن نصاب الاتهام لا قيمة له، ونصاب الاتهام تم تقديره ب 65% وهو ما يطلق عليه بعلم الإثبات بــــ (ظن مرتفع – دون أدنى شك)، يمكن أن يعوض عن القيم النسبية بألفاظ قانونية مماثلة، يتم اعتماد تقديرها من خبراء القانون والقضاء. يستفيد من هذا النموذج القاضي وقضاة التفتيش القضائي وقضاة النقض، وبهذا يساعد في تحقيق أكبر قدر ممكن من العدالة وإنجاز أكبر من القضايا وبطريقة أسرع.
