| 520 | |a يعتبر صاحب الانتاج الفكري مالك الحقوق المتعلقة به والمنصوص عليها في الأمر 2003-05 المؤرخ في 19 يوليو 2003 المتعلق بحقوق المؤلف والحقوق المجاورة. لكن إذا كانت هناك مؤلفات لا تحتاج لإنجازها سوى شخصا واحدا، حيث أنه يستفيذ من حقوق المؤلف، فهناك مؤلفات معقدة لايمكن إنجازها وتنفيذها إلا بمساهمة عدة أشخاص مثل المصنفات الجماعية. فالمصنف الجماعي هو الانتاج الذي شارك في إبداعه عدة مؤلفين بمبادرة وتوجيه شخص غالبا ما يكون معنوي، الذي يتولى الاشراف عليه ويقوم بنشره بإسمه الخاص. كما أن حقوق المؤلف ومنها الحقوق المالية في الانتاج الجماعي تعود إلىالشخص الطبيعي أو المعنوي الذي بادر بإنتاج المصنف وتولي الاشراف عليه. أما المؤلفين المساهمين فليس لديهم حقوقا في مجمل المصنف، لكنهم يستفيدون من اجور مقابل مساهاماتهم في تحقيق المصنف، ولديهم أيضا الحق في إستغلال مساهماتهم الفردية بإحترام شروط معينة. | ||
