| المستخلص: | Heavenly laws, international charters and declarations, and national legislations, such as the Jordanian legislation, are concerned with the protection of property right in that they emphasized the necessity of its respect, and prevented any intrusion on it or confiscation, unless for public benefit. This emanates from the importance of this right and the role that it plays in the service of society. This article discussed the legislative protection of property right. It reached the conclusion that even though property right is protected and cannot be encroached upon, or confiscated, unless according to the rules of law, it is no longer absolute, but it has a social function that aims to achieve the benefit of the whole society. لقد عنيت الشرائع السماوية والمواثيق والإعلانات الدولية والتشريعات الوطنية كالتشريع الأردني بحماية حق الملكية؛ فأكدت على ضرورة احترامه، ومنعت الاعتداء عليه آو مصادرته إلا للضرورة العامة؛ وذلك انطلاقا مما لهذا الحق من أهمية، ومن الدور الذي يلعبه في خدمة المجتمع. ناقش هذا البحث الحماية التشريعية لحق الملكية، وقد خلص إلى أن حق الملكية وإن كان حقا محميا لا يجوز الاعتداء عليه أو مصادرته إلا بموجب القانون إلا أن هذا الحق لم يعد مطلقا، بل إن له وظيفة اجتماعي؛ تهدف إلى تحقيق مصلحة المجتمع بأسره. |
