| المستخلص: | The international community has always end eavoured to protect against torture in either peace or war. When the quests failed to make up for the harm caused by the atrocious practices on the victims including the physical and psychological effects, the international law assures the victims of human rights violations of these rights the right to know the truth, the right of justice, and the right of compensating for harm. More over, the international judicature assures the victims the right of compensation of the harm and receiving their compensation once the accountability of the state or the officials has been proved. In consideration of the victims' rights of living a normal life, the UN has set up its relief fund for the victims so that they can continue their lives and forget the harm caused by the torture. However, the genuine compensation for the harm will not be achieved unless torture crime is labelled as one of the most perilous international crimes. لقد سعى المجتمع الدولي إلى الوقاية من جريمة التعذيب سواء في السلم أم في الحرب، ولما عجز سعى إلى إصلاح الأضرار التي تخلفها هذه الأعمال الشنيعة على الضحية من آثار جسدية ونفسية، وعليه يضمن القانون الدولي ثلاثة حقوق لضحايا انتهاكات حقوق الإنسان الحق في معرفة الحقيقة، والحق في العدالة، والحق في جبر الضرر. كما ضمن القضاء الدولي للضحايا حق جبر الضرر والحصول على التعويض متى ثبتت مسئولية الدولة أو موظفيها على ارتكاب التعذيب، ومراعاة لحقوق الضحية في العيش حياة عادية أنشأت الأمم المتحدة صندوق الأمم المتحدة لضحايا التعذيب، حتى يتمكنوا من مواصلة حياتهم ونسيان ما خلفه التعذيب من آثار سلبية. إلا أن جبر الضرر الحقيقي لا يتحقق إلا من خلال تقرير المسؤولية عن جريمة التعذيب كونها من أخطر الجرائم الدولية. |
