| المستخلص: | التحكيم بصفة عامة هو نظام للقضاء الخاص تقتضي فيه خصومة معينة عن اختصاص القضاء العادي ويعهد بها إلي أشخاص يختارون للفصل فيها وقد تكون إحالة الخصومة علي التحكيم نتيجة اتفاق بين الخصوم وهنا يكون التحكيم اختياري أو اتفاقي ويختار فيه المحكم ويتم تعيين نوع مقابل لهذا النوع من التحكيم ويطلق عليه التحكيم الإجباري وهو علي نوعين، فقد يكتفي المشرع بفرض التحكيم ويترك للخصوم حرية اختيار المحكم وتعيين إجراءات التحكيم وقد لا يكتفي المشرع بذلك ويتدخل اكثر وهنا لا يكون للخصوم أي دور ملموس في التحكيم وبغض النظر عن نوع التحكيم سواء كانت تحكيم إجباري أو اختياري فإن جوهرة كائن في تلك السلطة التي تمنح للمحكم للفصل في النزاع بقرار ملزم للطرفين بحيث يكون التحكيم نوع من القضاء ويعد المحكم بمثابة قاضي خاص مهمته حسم الخصومة بقرار ملزم. Arbitration in general is a system of private judiciary where a certain adversity requires the jurisdiction of the ordinary judiciary and is entrusted to persons chosen to be settled. The dispute may be referred to arbitration as a result of an agreement between the litigants and here the arbitration is optional or conclusive and the arbitrator chooses. The arbitration may be limited to two types. The legislator may only impose the arbitration and leave the opponents the freedom to choose the arbitrator and appoint arbitration procedures, and the legislator may not only do so and intervene more, and the opponents have no concrete role in arbitration, regardless of the type of arbitration, whether compulsory or optional. A gem is in that power granted to the arbitrator to settle the dispute by binding decision of the parties so that the arbitration is a type of judiciary and the arbitrator is a special judge whose task is to resolve the dispute by binding decision. |
