| المستخلص: | تكريسا للمساواة أكبر بين الزوجين وضمان حماية أفضل للأطفال وتحقيق الانسجام العائلي، استحدث المشرع الجزائري رقم 15-01 المتضمن إنشاء صندوق النفقة الذي يضاف بدوره إلى الترسانة القانونية التي تهدف إلى حماية الأطفال المحضونين والمرأة المطلقة الحاضنة، وذلك متى تعذر على المدين التنفيذ الكلي أو الجزئي للأمر أو الحكم الأمر بالنفقة، فيحل صندوق النفقة محل المدين في تسديد مبالغ النفقة المحكوم بها من أجل تسديد النفقة وذلك وفق إجراءات وشروط محدودة وفقا للقانون.
