| المستخلص: | The study aimed at revealing the nature of the prenuptial medical examination and the position of the Islamic law regarding this matter. The study dealt with four topics. The first topic, entitled the nature of the prenuptial medical examination and its objectives, and included several concepts, the most important of which is the concept of medical examination, the objectives of prenuptial medical examination. The second topic entitled prospects of prenuptial medical examination and its restrictions. The third topic was entitled the interest of Islam in the treatment of diseases, and finally the fourth topic, entitled the position of the Islamic law concerning the medical examination. The results of the study showed the deep belief in the validity of the Islamic jurisprudence, the perfection of its methodology, and that it is rich and meets all the requirements of life and the latest developments. They pointed out as well the dealing with the issue of prenuptial medical examination, including it in the section of Islamic politics. The study recommended tackling the contemporary issues, problems and the recurring happenings. Every era has issues, problems and recurrent events that previous scholars did not speak of. In that sense, jurists with true jurisprudential talents should study those issues, problems and facts.This abstract translated by Dar AlMandumah Inc. 2018 \nهدفت الدراسة إلى الكشف عن ماهية الفحص الطبي قبل الزواج وموقف الشريعة الإسلامية منه. وتطرقت الدراسة لأربعة مباحث هي كالتالي: المبحث الأول بعنوان :ماهية الفحص الطبي قبل الزواج وأهدافه، وتضمن عدة مطالب من أهمها ،مفهوم الفحص الطبي، واهداف الفحص الطبي قبل الزواج ،والمبحث الثاني بعنوان :إيجابيات الفحص الطبي قبل الزواج ومحاذيره، المبحث الثالث كان بعنوان: اهتمام الإسلام بعلاج الامراض، وأخيرا المبحث الرابع بعنوان :موقف الشريعة الإسلامية من الفحص الطبي .وأظهرت نتائج الدراسة الإيمان العميق بصلاحية الفقه الإسلامي، وكمال منهجه، وأنه يتسم بالثراء والوفاء بجميع متطلبات الحياة ومستجدات العصر، وكذلك إخضاع مسألة الفحص الطبي قبل الزواج وإدراجها ضمن باب السياسة الشرعية .أوصت الدراسة بمعالجة قضايا العصر ومشكلاته ووقائعه المستجدة ؛فلكل عصر قضاياه ومشكلاته ووقائعه المتجددة التي لم يتكلم عنها الفقهاء السابقون ؛فلابد للفقهاء ذوي الملكات الفقهية الراسخة الاجتهاد في تلك القضايا والمشكلات والوقائع. كُتب هذا المستخلص من قِبل دار المنظومة 2018 |
