| المستخلص: | \nهدف البحث إلى الكشف عن تغير الأحكام والفتاوى بتغير العرف والعوائد. واستخدم البحث المنهج الاستقرائي والتحليلي. وجاء البحث في مقدمة، وثلاثة مباحث، وخاتمة. تناول المبحث الأول قابلية الأعراف والعوائد للتغير وعدمه. وأشار المبحث الثاني إلى حجية العرف. وأوضح المحور الثالث تغير الاحكام والفتاوي بتغير الأعراف والعوائد. وأسفرت نتائج البحث أن العرف مصدر من مصادر الأحكام الإسلامية وهو معتبر في استنباط الأحكام، والعرف له صلة قوية بالمصلحة المرسلة لأنها مبينة على المصالح للمسلمين، وهناك بعض العرف يتناسب مع مقاصد الشريعة الإسلامية ولا يخالفها وهو معتبر عند الشرع. وتوصل البحث أن الثبات والمرونة في أحكام الشريعة يمثل إحدى خصائص التشريع في تيسيره على الناس ورعاية مصالحهم الثابتة والمتغيرة في جميع المجتمعات. وأوصي البحث بضرورة البحث العلمي في العرف الذي وقع في كثير من الأماكن هل هو مشروع أم ليس مشروعا، والمحافظة على العرف الذي يعتبر عند الشرع. كما أوصى البحث بالحاجة الماسة إلى إفهام المسلمين عن مكانة العرف في الإسلام. كُتب هذا المستخلص من قِبل دار المنظومة 2018 The aim of the research is to uncover the changes in the jurisprudential rulings and legal opinions according to the customs and traditions. The research used the inductive and analytical approach. It came in an introduction, three topics, and a conclusion. The first topic deals with whether the customs and the traditions are changeable or not. The second topic referred to the authority of the custom. The third topic clarified the change of the jurisprudential rulings and legal opinions according to the change of customs and traditions. The results of the research led to that the custom is one of the sources of Islamic rulings and is considerable in the inference of rulings. In addition, they led to that the custom has a strong link to the unspecified public interest because it is based on the interests of Muslims, as well as there are some custom commensurate with the purposes of Islamic Sharia "Divine law" and does not break it, which are considerable by the Sharia. The research found that firmness and flexibility in the rulings of the Sharia is one of the characteristics of the legislation in its facilitating on the people and taking care of their fixed and variable interests in all societies. The research recommended the need for scientific research on the custom, which mentioned in several places if it is legal or illegal, and maintain the custom, which is considerable according to the Sharia.
