| المستخلص: | هذا البحث الموسوم بــ- الجهاد بين المقاصد والوسائل، يتطرق بالدراسة المعمقة لمسألة هل الجهاد وسيلة أم مقصد؛ وذلك من خلال بيان معنى الجهاد والوسيلة والمقاصد، ثم بيان الفرق بين الوسائل والمقاصد، وتوضيح مقاصد الجهاد، ثم التطرق لمسألة الجهاد، هل هو مطلوب طلب الوسائل أم المقاصد وبيان المزلقة في الفهم من هذه الناحية، وقد أثبت الباحثان من خلال هذا البحث أن وجوب الجهاد إنما هو وجوب وسائل وليس وجوب مقاصد، أو بمعنى آخر الجهاد شُرّع وسيلة وليس مقصودًا في ذاته ولم يُشرّع لعينه، وإنما شرع لإعلان الدين ونشره، ودفع الظلم والفساد عن العباد والبلاد، كما أوصى الباحثان بالحذر من تحميل النص فوق ما يحتمل فيؤدي إلى التعدي في استعمال الجهاد، وكذلك من التوسع في الأخذ بالمصالح على حساب النصوص القطعية أو الظنية فيؤدي إلى تعطيل النص. . Jihad between the aims and means This modest research titled: "Jihad between the aims and means," deals with the deep study of the question of whether the jihad is means or an aim? Through clarifying the meaning of jihad and the means and aims and clarifying the difference between means and objectives, and to clarify the purposes of Jihad, then dealing with the issue of jihad. Is it required as means or an aims? And clarifying the diversion (Slipway) in the understanding of these meanings. The two researchers proved through this research this research that the necessity of jihad is means, not an aim or in other words, the legitimacy of jihad is means not an aim in itself and has not been prescribed for jihad only but prescribed for declaring and spreading religion and resisting injustice and corruption in the country and its people. The two researchers recommended caution to load the text above what it means because it leads to infringement in the use of jihad, as well as expansion in taking the interests instead of taking peremptory texts or conjectural text which lead to neglecting the text. |
