| المستخلص: | Considering the family as the cornerstone of building society, the Algerian legislator has surrounded it with legal protection to ensure its stability and maintain its continuity by criminalizing all acts that would harm the sanctity of the family and expose them to disintegration and degeneration, so the crimes within the family have overburdened the judiciary. With reference to Law No. 66/156 containing the Algerian Penal Code, which includes the amended Algerian Penal Code, which extends to Law No. 15/19 of 30th December 2015, we find that the Algerian legislature has singled out special provisions of the Penal Code for family offences. The prosecution of these offences is subject to special procedures that are appropriate to the specificity of offences within the family in order to provide more effective protection of family ties.\nThis abstract translated by Dar AlMandumah Inc. 2018 En considérant que la famille est la première base de construction de la société, le législateur Algérien l’a parée d’une protection pénale qui puisse garantir sa stabilité et préserver sa continuité, et ce, en criminalisant tout acte portant atteinte à l’intégrité de la famille ou menant à son déchirement et sa dissolution.\nLes crimes de famille sont considérés parmi les crimes qui alourdissent le fardeau de la jurisprudence, et en se référant à la loi 66/156 portant code pénal Algérien, modifiée et complétée et jusqu’à concurrence de la loi 15/19 du 30 décembre 2015, on constate que le législateur a promulgué des articles spécifiques aux crimes de famille.\nLe suivi pour cette catégorie de crimes est soumis à des procédures spéciales prévues par le législateur en concordance avec la particularité des crimes au sein des familles afin de leur procurer une protection efficace. إن الأسرة باعتبارها اللبنة الأساسية في بناء المجتمع، فقد أحاطها المشرع الجزائري بحماية قانونية لضمان استقرارها والمحافظة على استمرارها، وذلك من خلال تجريم كل الأفعال التي من شأنها أن تمس بحرمة الأسرة وتعرضها للتفكك والانحلال، فالجرائم داخل الأسرة أصبحت من الجرائم التي تثقل كاهل القضاء. وبالرجوع إلى القانون رقم 66/156 المتضمن قانون العقوبات الجزائري المعدل والمتمم إلى غاية القانون رقم 15/19 المؤرخ في 30 ديسمبر 2015م نجد أن المشرع الجزائري خص الجرائم الأسرية بنصوص خاصة في قانون العقوبات، وأخضع المتابعة في هذه الجرائم إلى إجراءات خاصة بما يتناسب وخصوصية الجرائم داخل الأسرة؛ وذلك إمعانا منه في توفير حماية أكثر فعالية للروابط للأسرية. |
