| المستخلص: | يهدف هذا المقال إلى تسليط الضوء على عقد الإيجار كوجه لتفويض المرفق العام في الجزائر، وذلك من خلال محاولة التعرف على مفهومه وأهم خصائصه وعلى أوجه التشابه والاختلاف بينه وبين عقود تفويض المرفق العام الأخرى (الامتياز، الوكالة المحفزة، التسيير)، فعلى الرغم من المزايا التي يحققها الإيجار في هذا المجال، إلا أنه وحتى وقت قريب لم يحظ بالاهتمام الكافي من قبل المشرع الجزائري إلى أن جاء المرسوم الرئاسي رقم 15-247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام الذي كرس لعقد الإيجار صراحة كشكل من أشكال تفويض المرفق العام. This article aims to highlight the lease as a mandate for the public facility in Algeria, by trying to identify its concept and its main characteristics, and on the similarities and differences between it and other public facility authorization contracts (franchise, motivating agency, management). Despite the advantages of rent in this area, until recently, the Algerian legislature did not pay sufficient attention to this matter until Presidential Decree No. 247-15 regulating public transactions and authorizing the public service, which was expressly devoted to the lease agreement, was introduced as a form of delegation to the public service.\nThis abstract translated by Dar AlMandumah Inc. 2018 Cette article vise à étudier le contrat d’affermage comme une forme de délégation de service public, en essayant de clarifier le concept, ses caractéristiques et les différences entre lui et les autres formes de contrats de délégation (concession, régie intéressée, gérance). Cependant, malgré les avantages du bail dans ce domaine, le contrat d’affermage n'a pas reçu suffisamment d'attention par le législateur algérien, que récemment avec la parution du décret présidentiel n ° 15-247, venu portant réglementation des marchés publics et des délégations de service public, qu’il l’a consacré explicitement comme une forme de délégation de service public. |
