| 520 | |a تعد الأموال عصب الاقتصاد الذي عزز بدوره وبشكل أساسي استقرار أمن الدولة الداخلي والخارجي واحد مقومات الأنظمة السياسية والاجتماعية السائدة في دول العالم. وقد حرص المشرع العراقي في السنوات الأخيرة على الاتجاه للمحافظة على هذا المال المشروع من التلوث بغيره من الأموال الغير مشروعة وذلك باتجاهه إلى مكافحة جريمة غسيل الأموال لما لها من اثر على اقتصاد البلد خصوصا مع ظهور الجريمة بشكل منظم من خلال الأعمال الغير المشروعة والجريمة المنظمة والصفقات التجارية المريبة التي تعقد بين بعض الأفراد والشركات وبعض الدول خصوصاً عندما يكون هؤلاء الإفراد من أصحاب السلطة والمال وكذلك فساد الموظفين الكبار في المؤسسات الرسمية مما أدى إلى انهيار الاقتصاد وضعف العملة واعتباره من أكثر البلدان انتشاراً لجريمة غسيل الأموال في العالم. وكون جريمة غسيل الأموال إحدى جرائم القرن المهمة التي تحمل في انعكاساتها السلبية الكثير من الآثار الخطيرة والحقيقية على الاقتصاد الوطني والعالمي عليه فقد حظيت الجريمة باهتمام بالغ من مختلف الهيئات الرسمية والغير رسمية للمجتمع الداخلي والدولي. ولحداثة هذه الجريمة بالنسبة للتشريع العراقي والقضاء في آن واحد فقد اتجهنا إلى اختيارها موضوعاً لبحثنا الموسوم ب (المسؤولية الجنائية الناشئة عن غسيل الأموال) دراسة مقارنة لمعالجتها بإطار قانوني ومعرفة ماهيتها وأركانها بشكل يمنع إدراج غيرها من الجرائم ضمن مفهومها أو إخراجها لتقع تحت طائلة مفهوم جرائم أخرى | ||
