| 520 | |a إن من سنن الله الكونية تبدل الأحوال، وتغير الظروف، والأزمان، ودوام التجدد، فلكل زمان أعرافه، وخصائصه، وإن مما اختص به هذا الزمان التطور العلمي، والتقدم التقني، ولقد كان للاكتشافات الحديثة أثرا في تغير بعض الفتاوى، ولا شك أن تغير الأعراف، والأزمان، والأحوال، لها أثرها على الفتاوى. وفي هذا البحث أتناول بالدراسة أثر تغير الأعراف في تغير الفتاوى وتبدلها، حيث نشهد تغيرا في بعض الفتاوى المعاصرة عما كانت عليه، مما يثير تساؤلا عن أسباب هذا التغير، وهذا البحث يجيب عن هذا التساؤل، بشيء من التأصيل العلمي، مستظهرا التطبيقات الفقهية المعاصرة الدالة على مدى أثر تغير الأعراف في تغير الفتاوى، وأثر ذلك كله على حركية الفقه ومرونته وفاعليته على مر الزمان. |b One of the basic God’s rules of life is changing circumstances, norms, patterns of life and time i.e. innovating and making changes in our life each time and every era or age has its special customs and characteristics. However, today time is characterized by the scientific progress and the technological development. Besides, those modern discoveries and inventions of our time have had an interesting impact on changing some of the contemporary Fatawa in accordance of what they were like . So, there is no doubt that customs, norms and time all together have their impact on the Fatawa. Thus, in this research we will study deeply and thoroughly how changes in the customs, norms and patterns of life can affect and change the Fatwa in our world - where we are witnessing a lot of changes in the contemporary jurisprudence. This research will answer this question using a scientific method trying to find the reasons for this change. We will also explain the contemporary jurisprudential applications and how they affect the changes in the Fatwa and the impact of all this on the effectiveness and flexibility of jurisprudence over time. | ||
