| المستخلص: | When the international community encountered the futility of imposing economic sanctions on countries considered to be non-followers of international legitimacy as these sanctions have only affected the inhabitants of these countries. They did not affact the persons having control of the decisions that have caused the imposition of such economic sanctions on their countries. This prompted the members of the international organization, through the United Nations International Council during the implementation of Article 41 of the Charter in order to deter such states, to reconsider the imposition of international economic sanctions in such a way that will enable them to control those who directly cause the situation which their countries reached within the international community in their relations with other states. This led to resort to so-called “smart sanctions, which we will address in this research.\nThis abstract translated by Dar AlMandumah Inc. 2018 Lorsque l’Organisation internationale a constaté l’inifiquacité des sanctions économiques internatioanles infligées aux Etats consédirées comme des Etats hors la legitilité internationale, parce que cela n’a touché que la population de ces Etats qui n’ont rien à avoir avec ce qui a était commis par les détenants du pouvoir qui sont la cause directe de ces sanctions. Ce qui a poussé les membres de l’Organisation, sciemment le conseil de sécurité de l’ONU on basant sur l’article 41 de la charte pour dissuader ces Etats, à revoir d’autres méthodes pour sanctionner d’une façon efficace les vrais coupables et non pas la population qui n’a rien à voir avec ces actes internationalement illégales. Cela a abouté au recours à ce qui a était défini comme « sanctions ciblées ». حينما اصطدم المنتظم الدولي بعدم جدوى تسليط العقوبات الاقتصادية على الدول التي اعتبرت خارجة عن الشرعية الدولية، حيث لم تمس هذه العقوبات سوى سكان هذه الدول دون الأشخاص المتحكمين في دواليب القرارات التي بسببها فرضت مثل هذه العقوبات الإقتصادية على دولهم. مما دفع بأعضاء المنظمة الدولية، بواسطة مجلس الدولي للأمم المتحدة حين تفعليه للمادة 41 من الميثاق بغية ردع مثل هذه الدول، الى إعادة النظر فرض العقوبات الإقتصادية الدولية بصيغة تمكنهم من لجم المتسببين المباشرين في الوضعية التي آلت إليها دولهم داخل المجتمع الدولي في علاقاتها بغيرها من الدول. أدى هذا الى اللجوء الى ما سمي "بالعقوبات الذكية، التي سنعالجها في هذا البحث. |
