| 520 | |b This study aimed to shed light on the subject of the legal requirements for the health authority in administrative functions, in terms of statement the concept of authority in administrative functions and enjoys the mandate of the easing of the burden on the owner of the president's inherent jurisdiction of the side. And it leads the other hand to achieve the speed and flexibility in business performance and boost the morale of subordinates and increase a sense of confidence in themselves and eliminates the negative and red tape, with the survival of the responsibility on the owner of inherent jurisdiction, because the mandate focused only on the administrative duties and functions without responsibility for those specialties. While addressing the formal requirements and substantive validity of the mandate, as the existence of an explicit legal provision authorizing the mandate, and that is partly the mandate and written and temporary, and will be for people who are identified by the text of the authorizing mandate, and exercise within the limits of resolution authorizing, and the inadmissibility of delegating competences delegated, or delegated authority unless there are legislative text explicitly authorizes the delegation of authority, with the possibility of the deployment resolution authorizing the official Gazette or any other ways that can cause the purpose of that. | 520 | |a هدفت هذه الدراسة الى تسليط الضوء على موضوع الشروط القانونية لصحة التفويض في الاختصاصات الإدارية, من حيث بيان مفهوم التفويض في الاختصاصات الادارية وما يتمتع به التفويض من تخفيف للعبء عن الرئيس صاحب الاختصاص الأصيل من جانب. ويؤدي من جانب آخر إلى تحقيق السرعة والمرونة في أداء الأعمال ورفع الروح المعنوية للمرؤوسين وزيادة الشعور بالثقة في أنفسهم ويقضي على السلبية والروتين، مع بقاء المسؤولية على صاحب الاختصاص الأصيل، وذلك لان التفويض ينصب فقط على الواجبات والاختصاصات الإدارية دون المسؤولية عن تلك الاختصاصات. مع معالجة للشروط الشكلية والموضوعية لصحة التفويض ,كوجود نص قانوني صريح يجيز التفويض , وأن يكون التفويض جزئياً ومكتوباً و مؤقتاً و ويكون للأشخاص الذين حددهم النص الآذن بالتفويض , وأن يمارس في حدود قرار التفويض و وعدم جواز تفويض الاختصاصات المفوضة , أو تفويض التفويض ما لم يكن هناك نص تشريعي صريح يجيز تفويض التفويض ,مع امكانية نشر قرار التفويض بالجريدة الرسمية أو أي طريقة أخرى تؤدي الغرض من ذلك. مع بيان للاستثناء من شروط صحة التفويض في حالة الظروف الاستثنائية، وأن سلطة الإدارة الاستثنائية يجب أن تقتصر علي الاستثناء الوارد في الدستور ولا تتعداه، ولا يجوز أن تمتد لغير حالات الضرورة والطوارئ، وأن أي مخالفة لشروط التفويض قد ترتب البطلان أو الانعدام، حسب مدي جسامة مخالفة قرار التفويض غير المشروع. | ||
