| المستخلص: | درس الباحثان عددا من الأمثلة والمسائل التي تشترك في علة السبق إلى المباح، كالخطبة على الخطبة والسوم على السوم وأحياء الموات ومنى مناخ من سبق وسلب المقتول وغيرها، فالسابق إلى هذه المباحات وسوها يظفر بحق لا تجوز المزاحمة عليه من غيره، هذا الحق يطلق عليه اسم حق السبق في الإسلام، وهو ليس عريا عن الشروط والضوابط فشأنه شأن الحقوق الأخرى المشروطة والمضبوطة. وقد درس الفقهاء الأمثلة والشواهد السابقة لكننا لا نجد عندهم مصطلح حق السبق وإنما وضعوا بعض هذه الأمثلة تحت ما يعرف بحق الاختصاص وتركوا البعض الآخر كمفردة فقهية منثورة في الأبواب والموضوعات. قام الباحثان بممايزة هذا الحق وفصله عن حق الاختصاص والاعتراف به تحت مسمى حق السبق. The researchers distinguished this right and separated it from the right of jurisdiction and recognition under the name of the lead right. |
