| المستخلص: | La prolifération du phénomène criminel dans plusieurs sociétés humaines a atteint un pic intolérable dans la société algérienne entre autre l’entité et la stabilité de sa sécurité sociale se trouve secouée. Cette situation a inclu un certain nombre d’éléments perceptibles de cette société, d’ordre psychologique, biologique et souciql, ceci étant visible par l’abondance du crime dan tous ces états tel le meurtre prémédité, la consommation des stupéfiants et le vol dans toute sa nature du simple au qualifié.\nLa société algérienne a donc sombré dans une crise sécuritaire multiforme: sociétale, financière, physique et morale ce qui a poussé les autorités algériennes à recourir à l’encrage de la réalité criminelle algérienne avec le déploiement d’une conscience basée sur l’éducation, l’éthique et la diffusion d’une culture de paix et réconciliation entre les individus. Elle tente aussi d’adapter les facteurs de la religion pour essayer d’approcher la charia qui viendra consolider les lois de la république, peut-être que tout cela arrêtera cette vague criminelle pour créer une société algérienne plus saine et basée sur une meilleur application des concepts Islamiques لقد بلغ انتشار الظاهرة الإجرامية حدا لا يطاق في العديد، من المجتمعات البشرية عامة، وفي المجتمع الجزائري، حصرا، حيث زعزع كيانها واستقرارها الاجتماعيين. وهذا بفعل توافر جملة من العوامل المفضية إلى ذلك، من عوامل نفسية وبيولوجية واجتماعية، الأمر الذي نتج عنه الكثير من الجرائم، مثل: السرقة والقتل العمد تحديدا، والمخدرات، والسرقة بنوعيها، البسيطة والموصوفة. وهو ما جعل كل شرائح المجتمع الجزائري يعيش أزمة أمنية، بكل أبعادها، الاجتماعية والجسدية (الصحية)، والمالية، والمعنوية. فقد ألجأ كل ذلك الدولة الجزائرية، إلى إرساء منهج من الفلسفة العقابية، تنهض أساسا بتطبيق ترسانة من النصوص القانونية الرادعة، وبالموازاة، تجتهد بالتفكير في سنّ واستحداث منظومة من التشريعات القانونية الجديدة، من منطلق قراءة ورؤية الواقع الإجرامي الجزائري. وفي الطرف الآخر، التركيز على نشر الوعي التربوي والأخلاقي، وبث ثقافة السلم والمواددة، والسلام الإنساني بين أبناء المجتمع الواحد، وشحذ الوازع الديني، كل من موقعه، في محاولة منها بلوغ ضفاف الشريعة الإسلامية الغرّاء، تعزيزا للقوانين الوضعية الموضوعة من قبل الجهات المعنية، عسى أن يكفل ذلك إيقاف هذه الموجة الإجرامية، وقيام مجتمع إسلامي خال ومجرد من ظاهرة الجريمة والانحراف، وكل أفعال الشرور الاجتماعي، وبالتالي، تكون تلك الروادع والجزاءات مقررة لتدعيم بنيان المجتمع الجزائري وسلامته، وهذا حفاظا على الأنا الاجتماعي. The prevalence of the criminal phenomenon has reached an intolerable extent in many human societies in general, and exclusively in Algerian society, where it has destabilized its social entity and stability. This is due to a range of factors, psychological, biological, and social, leading to many crimes, such as theft and wilful murder specifically, drugs, theft of both kinds, simple and described. This has caused all segments of Algerian society to live in a security crisis in all its dimensions, social, physical (health), financial and moral. The Algerian State has established a punitive philosophy that promotes the application of an arsenal of deterrent legal texts and, in parallel, strives to consider the enactment and development of a system of new legal legislation, based on the reading and vision of the Algerian criminal reality. At the other end, focus on raising educational and moral awareness, spreading a culture of peace and religion, and human peace among the members of the same society, and honing religious belief, from every occasion, in an attempt to reach the banks of Islamic law, in order to strengthen the existing laws drawn up by the concerned authorities; may this ensure the cessation of this wave of crime and the establishment of an Islamic society free from the phenomenon of crime and delinquency, and all acts of social evils. Consequently, these deterrents and sanctions are planned to strengthen the structure and integrity of Algerian society, and this is to preserve the social ego.\nThis abstract translated by Dar AlMandumah Inc. 2018 |
