The study aimed to introduce arbitration in terms of origination and development and related laws at the national, regional and global level, then stand on the importance of arbitration, and the most important findings of this study is: lack of proper understanding of the arbitration by specialists relevant, and that the failure to keep up with its own universal laws because they In the case of continuously increasing flexible nature that are in line with the issues of a commercial nature only at the national or regional level, and the development and preparation of specialized cadres at all levels and entrusted with this assignment and the Sudanese Ministry of Justice, which represents the subject of the implementation of these recommendations center. | ||
| 520 | |a جاءت هذه الدراسة بعنوان (دور التحكيم في تسوية المنازعات) دراسة مقارنة وتمثلت مشكلة الدراسة في التطويل والتأخير الذي يلازم القضايا ذات الطابع التجاري، وطبيعة العمل التجاري التي تتطلب السرية والأمان والسرعة هذه لا تقتصر إلى في التحكيم. حيث جاء هيكل الدراسة مكونا من ثلاثة فصول تناول الفصل الأول البعد التاريخي للتحكيم وذلك من خلال مبحثين معرفا التحكيم ومشروعيته وطبيعته، أما الفصل الثاني تناول خصوصية التحكيم من خلال ثلاثة مباحث تناولت مميزاته وأنواعه والتعريف ببعض منظماته، ثم الفصل الأخير تناول قرارات التحكيم وطرق الطعن فيه وذلك من خلال مبحثين تناول صدور القرارات وكيفية الطعن فيها وحجيتها وطرق تنفيذها ثم الخاتمة التي تحتوي النتائج والتوصيات، وأهم المصادر والمراجع. هدفت الدراسة للتعريف بالتحكيم من حيث النشأة والتطور والقوانين ذات الصلة على المستوى الوطني والإقليمي والعالمي، ثم الوقوف على أهمية التحكيم، وأهم ما توصلت إليه هذه الدراسة، عدم الفهم الصحيح للتحكيم من قبل المختصين ذو الصلة، كما أن عدم مواكبة القوانين العالمية الخاصة به، لأنها في حالة ازدياد مستمر لطبيعته المرنة التي تتماشى مع القضايا ذات الطابع التجاري سوى على المستوى الوطني أو الإقليمي وتطويره وإعداد كوادر متخصصة على جمع المستويات ومنوط هذا التكليف هو وزارة العدل السودانية التي تمثل مركز تنفيذ موضوع هذه التوصيات. | ||
