| المستخلص: | برزت الحقوق الاجتماعية في القرن التاسع عشر نتيجة موجة من احتجاجات العمال المطالبة بضرورة التكفل بمشاكلهم والعمل على مكافحة المعاملة التمييزية المتواجدة. وجهت تلك الحقوق بهدف تحسين الظروف المعيشية للعمال تطبيقا لمبدأ التضامن. أعترف التصريح العالمي بالحقوق الاقتصادية والاجتماعية الخاضعة للاتفاقيات الاقتصادية التي من شأنها أن تضمن لكل أمة حياة آمنة في وقت السلم بالنسبة لمواطنيها المتواجدين في العالم. وفي هذا السياق، عهد المؤسس الدستوري المغربي على تكريسه الحماية للحقوق الاجتماعية الأساسية سواء كانت مشروطة كحق التعليم أو غير مشروطة كالحق في الإضراب. Les droits sociaux émergents au 19ème siècle , Ils s’inscrivent dans les revendications ouvrières, aux problèmes des travailleurs et la nécessité de prendre en compte les inégalités existantes. \nIls ont pour but l’amélioration des conditions de vie des personnes selon le principe de solidarité .La Déclaration universelle reconnaissait des droits économiques et sociaux soumis aux accords économiques susceptibles d’assurer à chaque nation une vie saine en temps de paix pour ses habitants - partout dans le monde». \nDans ce cadre, La Constitution marocaine protège les droits sociaux fondamentaux. Les droits sociaux dans la constitution marocaine distingue: \nLes droits sociaux inconditionnels ou originaux : exemple, le droit de grève \nles droits sociaux conditionnels : exemple le droit à l’éducation, le droit à la santé.la justiciabilité est constitutionnellement reconnue et les Conventions internationales dûment ratifiées. Social rights emerged in the nineteenth century as a result of a wave of protests by workers demanding the need to take care of their problems and to combat existing discriminatory treatment. These rights were aimed at improving the living conditions of workers in accordance with the principle of solidarity. The Universal Declaration recognized the economic and social rights subject to economic agreements that would guarantee every nation a safe life in peacetime for its citizens in the world.
