| المستخلص: | الحمد لله، والصلاة والسلام على رسول الله صلى الله عليه وسلم، وعلى آله وصحبه ومن والاهم بإحسان إلى يوم الدين، فهذه ورقة بحثية في زكاة مزارع الألبان وإنتاج الدواجن، تتناول أحد الموضوعات الاقتصادية الهامة ذات التأثير على الفقه الزكوي المعاصر، أعددته ليكون مساهمة في مثل هذه النوازل الزكوية بشيء من التفصيل بضبطه ودراسة المسائل الفقهية التي تنبني عليه، مبينا فيه مفهوم مزارع الألبان وإنتاج الدواجن، وأهمية زكاة هذا النوع من الثروات والأوعية الزكوية المعاصرة والتي تناولها فقهاء العصر، كما تناولت حكم زكاتها، والموضوع ذو أهمية بالغة لضخامة الحجم الاستثماري في هذا القطاع، ولضرورة معرفة التكييف الفقهي الصحيح له، كما يتأكد بيان حكم الشرع في مثل هذه الأموال في ظل هذه المتغيرات التي يمر بها العالم اليوم، والتي تشهد تفشيا للفقر والبطالة، وانتشارا لوسائل الكسب غير المشروع، والتفاوت الطبقي المريع، من ثراء فاحش، وفقر مدقع، كل تلك الأسباب مجتمعة، تجعل الزكاة من الضرورات الملحة، التي يجب إعادة النظر في حيثيات هيكلتها، وترسيخها عالميا، ليكون الهدف هو إحياء هذه الفريضة العظيمة، وتعظيم شأنها، وتفعيل دورها في التنمية الشاملة بأسلوب يناسب العصر .. ومنهج الورقة هو المنهج الاستقرائي، ثم المنهج التحليلي الذي يجمع ويفرق بين الأقوال ويوجه الأدلة ومن ثم يرجح. ويبين رجحان زكاة غلتها زكاة التجارة. All Praise is due to Allah, and Prayers and Peace on the Prophit Peace Be Upon him and on his Companions and all those followed them till the Day of Judgment. This is a research paper on Zakat upon poultry production farms. It touched on one of the most important economic topics, which has an effect on the contemporary zakat figh (jurispridence). I prepared it in order to be a detailed contribution to zakat nawazils by studying the figh matters on which they based. I explained the concept of poultry production farms, importance of such zakat compared to other contemporary types of zakat that have been tackled by contemporary scholars. it, futher, touched on rule of its zakat. The topic is very significant due to huge investment in this sector and also, to know the correct figh adaptation of it. The rule of legitimacy in such funds in the light of variable that the whole world is currently witnessing. They witness a wide spread of poverty and unemployment, illegal means of livelihoods, horrible inequality such ill-gotten money and abject poverty. All the aforesaid combined reasons make zakat a necessity. Thus its structure should be reconsidered in order to consolidate it globally for the goal behind this is to revive and glorify this duty and to reactivate its role in the comprehensive development in a way that suits the era. The methodology of the paper was inductive and then the analytical methodology, which combines, differentiates between sayings, directs evidences and then overbalances. It was evident that it should be treated as Zakat upon trade. |
