| المستخلص: | Praise be to Allah, Who speaks the truth and guides us to the straight path, and peace and blessings be upon our prophet, Muhammad, the Seal and imam of all Prophets. The administration of hudud [prescribed legal penalties] is a great blessing and a mercy from Allah the Almighty upon His servants. Hudud has been enjoined to preserve and protect religion, life, honor, wealth, and intellect. It is an effective cure towards the reformation of nations, consolidates security and stability everywhere, and curbs crime and purges corruption, treason, and oppression. A society that does not punish crime is corrupt and divided and falls in a state of constant chaos and disorder. This paper consists of an introduction, three research topics, and a conclusion. The introduction comprises a definition of the research subject, its importance, and the research plan. The first research topic comprises a definition of hudud, its legitimacy, and the benefit of its implementation. The second research topic comprises the definition of crime, waiving hudud and its impact on the spread of crime, and the Islamic approach towards combating crime. The third research topic comprises the role of Islamic legal punishments and its impact on combating crime and discusses seven issues: 1- The impact of implementing the penalty for apostasy on the prevention of leaving Islam. 2- The impact of implementing the penalty of retaliation on the prevention of homicide. 3- The impact of implementing the penalty for hirabah on the prevention of corruption on earth. 4- The impact of implementing the penalty for fornication on its prevention. 5- The impact of implementing the theft penalty on misappropriation. 6- The impact of implementing the penalty for intoxication on the prevention of alcohol consumption. 7- The impact of implementing the penalty for slander on preserving honor. The conclusion comprises the most important results reached. |
