| المستخلص: | تعتبر العلامة التجارية كحق من حقوق الملكية الصناعية ذات قيمة مالية ومعنوية كبيرة، إذ تعد إحدى الوسائل التي تميز كل منتج عن غيره وبالتالي تبعد المستهلك عن التضليل وتكسبه الثقة في المنتج، ونظرا لهذه القيمة أضحت عرضة للاعتداء عليها لا سيما عن طريق التقليد، الأمر الذي ألزم المشرع الجزائري أن يوفر لها الحماية اللازمة بتجريمه لهذه الأفعال وتقريره عقوبات رادعة ضد المعتدين للحد منها.
