| المستخلص: | Le recueil el miryar d'al-Wancharissi nous met en face à la vie quotidienne de la société dans l’Occident musulman à travers les fatwas des faqihs malikites de l’Occident musulman dont on touche à un aspect singulier de la situation complexe des esclaves dans le maghreb et en particulier en Andalousie à l’époque du Moyen Age. L’historien, autant que le juriste et l’anthropologue، y trouvent matière à réflexion, à condition que chacun s’entoure des précautions propres à sa discipline.\nRappelons que la fatwa est une opinion légale émise par le mufti qui est un faqih، juriste expérimenté en matière de charia. Elle répond à une question posée par un requérant qui voudrait agir dans un cas pratique en conformité avec la Loi et n’a pas de valeur contraignante. Elle pourrait aussi être émise à la demande du cadi qui est entouré en Occident musulman d’un certain nombre de muftis officiels qui le conseillent dans les affaires qui lui sont soumises. Le cadi tient compte de toutes les fatwas émises par ses conseillers avant d’émettre son jugement. Abu Abbas al-Wancharissi s’est basé sur les fatwas de ses antécédents tel Abu el walid Ibnou Rochd, Ibnou Hadj، Imam Sahnoun et autres .\nCette étude aborde un aspect vital et important concernant la liberté des esclaves et les méthodes et les techniques, conduisant à sa libération de l'esclavage d’après les fatwas cités par Abu Abbas al-Wancharissi. El Miryar collection of al-Wancharissi we met in the daily life of society in the Muslim West through the fatwas of the Maliki's jurisprudence of the Muslim West touched on a unique aspect of the complex situation of slaves in Maghreb and in particular in Andalusia during the Middle Ages. The historian, like the jurist and the anthropologist, finds a material for thought, provided that each surrounds himself with the precautions proper to his discipline.\nI mention that the fatwa is a legal opinion issued by the mufti who is a jurist experienced in Sharia. we answer a question asked by an applicant who would like to act in a practical case in accordance with the law and has no binding value. It could also be issued at the request of the judge who is surrounded by the Muslim West by a certain number of official muftis who advise him in the cases submitted to him. The judge takes into account all the fatwas issued by his advisers before issuing his judgment. Abu Abbas al-Wancharissi relied on the fatwas of his antecedents such as Abu el Walid banu Rochd, Ibn Alhaj, Imam Sahnoun and others.\nThis study addresses a vital and important aspect regarding slave freedom, methods and techniques, leading to his liberation from slavery based on the fatwas cited by Abu Abbas al-Wancharissi.\nThis abstract translated by Dar AlMandumah Inc. 2018 |
