| 520 | |b This research deals with foreign investment disputes and the applicable law, as foreign investment deems to be one of the most important aspects of the economical activities at the moment, and constitutes great importance in the socioeconomic development for any country, being a mean through which the capital as well as knack technical flow to the country. For this reason, the States and international community regulate foreign investment operations through the national acts and international conventions in order to specify the legal guaranties movement and utilization of capital. In addition, it provides the legal environment that limits and mitigates the obstacles and disputes which lead to restriction or suspension of investment in some instances. One of the guarantees is to determine the applicable law when a dispute arises Based on these facts; this research to deal with different forms of investment disputes, and how to determine the relevant applicable law. It is an attempt to lay down clear principles through analysis of different legal systems by using the analytical descriptive method. Findings of the research can be in absence of clear investment plans and the instability of the financial, economical and legislative policies, a matter that led to many investment disputes. The most important recommendations of the research can be summarized in the issue of investment laws according to clear plans, in addition to exertion of efforts towards proportional stability of the economic, financial and legislative policies through long-term plans, besides the necessity to encourage the collective and mutual conventions of States in investment field. | ||
| 520 | |a يتناول هذا البحث منازعات الاستثمار والقانون الواجب التطبيق، حيث إن الاستثمار الأجنبي يعد من أهم أوجه النشاط الاقتصادي في الوقت الراهن، ويشكل أهمية كبرى في التنمية الاقتصادية والاجتماعية لأي دولة ، باعتباره الوسيلة إلي يتدفق عبرها رأس المال والخبرة الفنية. لذلك تنظم الدول عمليات الاستثمار الأجنى من خلال القوانين الوطنية والاتفاقيات الدولية، التي تحدد الضمانات لحركة رؤوس الأموال واستغلالها، مع توفر بيئة قانونية تحد وتخفف من المعوقات والمنازعات إلى تؤدي إلى تقييد الاستثمار أو توقفه في بعض الحالات. ومن تلك الضمانات تحديد القانون الواجب التطبيق عند المنازعة . واستنادا لهذه المعطيات جاء هذا البحث لتناول صور منازعات الاستثمار، وكيفية تحديد القانون الواجب التطبيق عليها، كمحاولة لوضع أسس واضحة لذلك ، من خلال تحليل القواعد القانونية المختلفة ، باستخدام المنهج الوصفي التحليلي . وعلى ضوء ذلك، توصل البحث لنتائج منها غياب الخطط الواضحة للاستثمار، وأن عدم ثبات السياسية الاقتصادية والمالية يؤثر على النظم التشريعية ، المنظمة لعملية الاستثمار مما تسبب في كثير من منازعات الاستثمار. ومن أهم توصيات البحث ضرورة استصدار قوانين الاستثمار، وفقا لخطط واضحة مع بذل الجهود نحو ثبات نسبي للسياسيات الاقتصادية والمالية من خلال خطط طويلة الأجل ، مع ضرورة تفعيل القوانين المنظمة للاستثمار وتشجيع الاتفاقيات الدولية الجماعية والثنائية في مجال الاستثمار. | ||
