| المستخلص: | تتعدد صور الملكية الصناعية وتتجدد نظراً للتطورات الحاصلة في مجال تكنولوجيا الإعلام والاتصال، ومسايرة منه لهذا التوجه الجديد ومواكبة منه لاتفاقية الجوانب المتصلة بالتجارة من حقوق الملكية الفكرية (تريبس)، التي تسعى الجزائر للانضمام إليها عمد المشرع الجزائري إلى تكييف منظومته القانونية مع متطلبات الانضمام إلى هذه الاتفاقية. من أجل ذلك أدخل المشرع الجزائري تعديلات جوهرية في النصوص المتعلقة بحماية الملكية الفكرية، كما استحدث صور جديدة لم تكن معروفة من قبل في التشريع الجزائري ونحن نعني التصاميم الشكلية للدوائر المتكاملة موضوع الدراسة باعتبارها صورة من صور الملكية الصناعية، وقد نظمها بموجب أحكام الأمر 03 / 08 وكذا مرسومه التنفيذي رقم المرسوم التنفيذي رقم 05/276 المؤرخ في 02 غشت 2005؛ الذي يحدد كيفيات إيداع التصاميم الشكلية للدوائر المتكاملة وتسجيلها المعدل والمتمم، فإلى أي مدى وفق المشرع الجزائري بمقتضى هذه النصوص الأخيرة في توفير الحماية لصاحب التصميم الشكلي، وهل هذه الحماية تلقائية أم متوقفة على إجراءات معينة يتعين على صاحب الحق القيام بها حتى يحظى بالحماية.
