This study aims to highlight the importance of knowing the jurisprudence of reality and purposes of the law of the Mufti and industrious, especially with regard to Muslim minorities. This study was divided into an introduction and two sections and a conclusion included the findings and recommendations and are as follows: First topic: the definition of each of the controls and Fiqh and minorities in the language and Astalah.alambges II: controls the jurisprudence of minorities, followed by a field study is to identify opinion poll on the fatwa in Europe. And it ends with a conclusion research focuses on the most important findings of the researcher, and recommendations that are recommended by the calls to them. يعد فقه الأقليات من الأمور التي تحتاج إلى دراسة ومزيد عناية, وخاصة في وقتنا هذا, ولا يمكن لعلمائنا اليوم الحكم على واقعة من الوقائع إلا بعد النظر فيها وتصورها ومعايشتها, بل يعتبر ذلك من شروط الفتوى والاجتهاد, كما قال ابن القيم رحمه الله: "لا ينبغي للرجل أن ينصب نفسه للفتيا حتى يكون فيه خمس خصال, منها معرفة الناس", وإذا كان هذا الكلام يقال في زمن ابن قيم, ففي وقتنا هذا نحن بحاجة لهذا القول, فمن هنا أتت الفكرة, وتهدف هذه الدراسة إلى إبراز أهمية معرفة فقه الواقع ومقاصد الشريعة للمفتي والمجتهد, وخاصة فيما يخص الأقليات المسلمة, وقسمت هذه الدراسة إلى مقدمة ومبحثين وخاتمة اشتملت على نتائج وتوصيات وذلك على النحو التالي: المبحث الأول: تعريف كل من الضوابط والفقه والأقليات في اللغة والاصطلاح, المبحث الثاني: ضوابط فقه الأقليات ويليه دراسة ميدانية عبارة عن استبانة استطلاع رأي حول الفتوى في أوربا. وينتهي البحث بخاتمة تركز على أهم النتائج التي توصل إليها الباحث, والتوصيات التي ينصح بها ويدعو إليها. |
