| المستخلص: | يهتم موضوع البحث بتوضيح مسألة الأسباب المنشئة للمسؤولية المرتبطة بالإعلام ما قبل التعاقدي في مجال عقود الأعمال، لاسيما عقد التوزيع بترخيص استعمال العلامة التجارية، حيث يتحقق الإعلام من خلال ما يعرف بوثيقة الإعلام المسبق، كما أن مسؤولية المرخص باعتباره المدين بالإعلام المسبق في حال ثبوتها تأخذ عددا من الأشكال اهتم هذا البحث بعرضها ومناقشتها من خلال الرجوع إلى الأنظمة المقارنة، لاسيما منها القانون الفرنسي قانونا وقضاء، ومحاولة التقريب مع ما هو موجود في الجزائر. The study focuses on the question of facts giving rise to the liability for pre-contractual information relating to business contracts and essentially commercial franchise contract, and the question of different forms of responsibilities under the Failure by the franchisor of its obligation to provide the benefit of the franchisee document pre-contractual information; Failure by the franchisor's obligation to provide the benefit of the franchisee, the precontractual information herein with reference to his analysis, including the French comparative legal systems. Cette ’étude en se référant par son analyse aux régimes juridiques comparés, notamment français, s’intéresse à la question des faits générateurs de la responsabilité relative à l’information précontractuelle en matière de contrats d’affaires, et essentiellement le contrat de franchise commerciale. Elle s’intéresse aussi à la question des différentes formes de responsabilités découlant du non respect par le franchiseur de son obligation de fournir, au profit du franchisé, le document d’information précontractuelle. |
