| 520 | |a لقد تبنى المؤسس الدستوري في الجزائر مبدأ وحدة إقليم الدولة منذ الاستقلال واعتمد على النظام الإداري اللامركزي كأسلوب لإدارة هذا الإقليم . بذلك قسمت الجزائر إلى وحدات إدارية سميت بالجماعات الإقليمية ممثلة في البلدية والولاية، واعترف لهما بالاستقلال الإداري والمالي مرة، وبالاستقلال الإداري والذمة المالية المستقلة مرة أخرى. غير أنه في المقابل كان للمشرع نظرة أخرى بإضفاء عليهم طابع آخر والمتمثل في إعادة تكييفهما بأنهما دائرتين إداريتين غير ممركزتين للدولة حفاظا على وحدة إقليم الدولة. ومنح لهاتين الجماعتين الإقليميتين اختصاصات إدارية واسعة وغير دقيقة، وفي نفس الوقت فرض عليهم رقابة إدارية ووصائية مشددة، جعلت من الهيئتين الإقليميتين مجرد إدارة غير ممركزة تخضع للسلطة المركزية، مما أثر سلبا على القواعد الأساسية للامركزية المكرسة في الدستور من جهة وعلى الأداء الإداري من جهة أخرى. | ||

| 520 | |d La constitution algérienne a opté pour l’unité du territoire Algérien depuis l’indépendance, mais il a choisi le régime de la décentralisation comme moyen de gérer ce territoire. Pour cette raison, l’Algérie a été divisé en circonscription administrative érigé en collectivité territoriale représente par la wilaya et la commune, et les a doté d’une autonomie administrative et financière au début et par et par une autonomie administrative et patrimoniale par la suite. Par conséquent, le législateur a une autre vision en qualifiant ces deux entités en circonscription administrative déconcentré de l’Etat pour garantir l’intégrité du territoire. Il les a dotés par des compétences très larges d’une part et il les a soumis à une tutelle et un contrôle très strict d’autre part. De plus ces collectivités sont devenues une simple administration déconcentrée soumise à l’autorité centrale, ce qui influe sur le principe de la décentralisation d’un côté et sur la performance de l’administration. | ||
