| المستخلص: | No one said scientists permissible to dispose of money in the suspended Unlike the will of the owner, if he could use it, the more privacy if it is disabled so they do not benefit from it, and notes that, in our time, people are not aware of this provision, but lead them to do that desire to do good, without the knowledge of the jurisprudence of this transaction, and then it became not aware of the fact that money suspended and the seriousness of assault him, and therefore between this research need money detainee care, maintenance and repaired and architecture, and survival Mentfa him, and sentenced to sell it or replace it with other when you are not fit for use by him, or if the other more benefit from it, with a statement that branches of contemporary applications. التَّصَرُفُ في الوَقفِ عَلَى غَيرِ مَا أَرَادَهُ الوَاقِفِ -مَعَ إمكَانِيَّةِ الاستَفَادَةِ مِنهُ كَمَا أرَادَ - أَمرٌ لَا يَقُولُ أَحَدٌ بِجَوَازِهِ, وَيَزدَادُ حُرمَةً إِذَا عُطِّلَ؛ وَلَكِنَّ المُلَاحَظَ فِي الآوِنَةِ الأَخِيرَةِ عَدَمُ إدرَاكِ النَّاسِ حُكمَ ذَلِكَ, وَإنَّمَا يَسُوقُهُم إلى ذَلِكَ رَغبَتُهُم فِي فِعلِ الخَيرِ بِدُونِ مَعرِفَةٍ لِفِقهِ الوَقفِ, فَأَصبَحُوا لَا يَعُونَ حَقِيقَةَ الوَقفِ وَخُطُورَةَ التَّعَدِّي عَلَيهِ, وَنَاقَشَ هَذَا البَحثُ الوَقفَ إذَا تَعَطِّلَت مَنَافِعُهُ, وَصِيَانَتَهُ وَإصلَاحَهُ وَعِمَارَتَهُ, وَحُكمَ بَيعِهِ أَو استِبدَالِهِ إذَا تَعَطَّلَت مَنَافِعُهُ, وَحُكمَ ذَلِكَ إذَا لَم تَتَعَطَّل مَنَافِعُهُ وَبَدَلُهُ خَيرٌ مِنهُ نَفعَاً وَثَمَرَةً, مَعَ ذِكِرِ تَفرِيعَاتِ ذَلِكَ, وَتَطبِيقَاتٍ مُعَاصِرَةٍ, وَأَمثِلَةٍ مُتَجَدِّدَةٍ. |
