| المستخلص: | The Ancient civilizations such as Pharaonic and Greek knew the so-called phenomenon of asylum for religious reasons where the refuge and flee was to the temples: this phenomenon also appeared in the pre-Islamic era and the beginning of the rise of Islam through migration to Abyssinia, it have evolved to become a truly authentic lights beginning from the eighteenth century but confined on the perpetrators of ordinary not political ciimes. The asylum is an individual temporary light of the that he hopes will get legal and sometimes humanitarian protection provided in international and domestic legal rules, and it is granted according to circumstances and conditions without discrimination, but in cases such as the necessity and national security, the lights of asylum seekers are \iolated especially with the evolution of human security concept and its integration with homeland security. الحضارات القديمة كالفرعونية واليونانية عرفت ما يسمى بظاهرة اللجوء لأسباب دينية أين كان الملاذ والفرار إلى المعابد كما ظهرت أيضا في العصر الجاهلي ثم بداية ظهور الإسلام من خلال الهجرة إلى الحبشة، وقد تطورت تلك الظاهرة لتصبح حقا من الحقوق الأصيلة بداية من القرن الثامن عشر مع انحصاره على مرتكبي الجرائم العادية دون السياسية. وحق اللجوء حق مؤقت للفرد يأمل من خلاله في الحصول على حماية قانونية وأحيانا إنسانية محددة في قواعد قانونية دولية وداخلية، ويمنح وفق ظروف وشروط ودون تمييز، لكن في حالات مثل الضرورة والأمن القومي، تنتهك حقوق اللاجئين خاصة مع تطور مفهوم الأمن الإنساني وتكامله مع مفهوم الأمن القومي. |
