المستخلص:The political role of the judiciary is relatively a new subject of study in political science. This role varies according to many factors, such as the political system, the government, the relations between the political and judicial institutions, and the judiciary institution itself. Accordingly, this study aims to answer the following questions: 1- What is the political role of the judiciary in contemporary political systems? 2- What are the forms and limits of this role in Africa, with emphasis on South Africa? To answer these questions, the study presents different definitions and interpretations of the political role of the judiciary, or the involvement of the judiciary in the political process in comparative political systems. It also discusses causes of this political role, then focuses the analysis on the role of the judiciary in the process of democratization and constitution writing in South Africa. The study concludes that the political role of the judiciary is a new important role and has clear impacts on the interactions of the South African political system
