| المستخلص: | هدفت هذه الدراسة إلى بحث البصمة الصوتية وأثرها في إثبـات الجريمـة واحتوت هذه الدراسة على مقدمة بدورها احتوت على أسـباب وأهـداف وأهميـة الموضوع ومشكلاته والمنهج المستخدم في كتابة الورقة البحثية. \ كما وقد قدم الباحث رأي الشريعة و قانون الإثبات السـوداني وبع ـض القوانين الإجرائية الأخرى دليل من هذه البصمة الصوتية الحديثة واعترافه ببعضها صراحة (نصا) وبعضها الأخر ضمنا( عن طريق الاستنتاج مـن فحـوي ومعنـي وروح القانون ) مقارنا بذلك القانون الأجنبي . وتوصل الي النتائج التالية: \ الأخذ بدليل البصمة الصوتية يؤدي إلى اتساع دائرة الإثبات الأمـر الـذي يمكـن السلطة من ملاحقة المجرم وتنزيل العقوبة عليه. عند مناقشة البينة الصوتية تطرق الباحث إلى قرينة التسجيل الصوتي والتلفزيوني وظهر لي أن قـانون الإجـراءات الجنائية لسنة 1991م خاليا من أن نصوص تنظيم إجراءات تسجيل المحادثات This study aims at investigating phonetic print and its effect on proving crime. The study includes an introduction which involves aims and objectives, significance, statement of the problem and the methodology of writing the research paper. The two researchers introduce Sharia opinion and Sudanese law of evidence and sore other laws of procedures as a clue to this modern phonetic print and its explicit confession, other implicit (through deduction from the sense, meaning and spirit of law) in comparison with the foreign law.The study reveals that: accepting the phonetic print leads to enlarging the evidence circle, the thing which enables the authority to go after the criminal and punish him. When discussing the phonetic print, the two researchers deals with the sound recording and T.V clue, and they discovered that Sudanese law of criminal procedures for the year 1991 Lacks the articles organizing the procedures of conversation recording. |
