| المستخلص: | The article aimed to highlight the book (Deducted warnings against collected and mixed books) by the Judge Ayyad to explain the corrupt sales. The article discusses the reasons of forbidding and spoiling the sale, which are four, namely, the reason of time when it is not permissible to sell, and the reason of the contractors, and the reason of condition associated to the sale, and finally the reason of attached right of someone other than seller's right to sale. In addition to highlighting the conditions associated with the sale, which are four parts; part of which is required by the contract, and another section for the requirement of the interests of selling or permitting it, and the requirement to restrain some of the benefits of the owning and to dispose it. Some conditions are not desired, if it is conditioned, becomes void and sale is effective. The article concluded that corruption in the sale is for many reasons, and the questions and images have known titles, names, and images, and collected in six types, five of which spoil it in self, and the sixth spoils it for what attached from other.This abstract translated by Dar AlMandumah Inc. 2018 استهدف المقال تسليط الضوء على كتاب "التنبيهات المستنبطة علي كتب المدونة المختلطة" للقاضي عياض لبيان البيوع الفاسدة. كما تناول المقال علل تحريم البيع وفساده وهي أربع علل تتمثل في، العلة بالوقت حيث لا يجوز فيه البيع، والعلة في المتعاقدين، والعلة كشرط قارن بالبيع، وأخيرا علة تعلق حق لغير البائع بالمبيع.بالاضافة إلى إبراز الشروط المقترنة بالبيع والتي تمثلت في أربعة أقسام هي كالتالي، قسم منها يقتضيه العقد، وقسم أخر لاشتراط ما هو من مصالح البيع أو أبيح فيه، واشتراط تحجير بعض منافع الملك والتصرف فيه، ومن الشروط ما يخف فيكره ابتداء لآجل معين، فإذا وقع سقط وصح البيع. وأختتم المقال بأن الفساد في البيع يكون لعلل كثيرة، ولمسائله وصوره ألقاب وأسماء وصور معروفة، ويجمعها ستة أنواع، خمسه مما يفسده في نفسه، والسادس ما يفسد لما يلحقه من غيرهكُتب هذا المستخلص من قِبل دار المنظومة 2018 |
