| المستخلص: | تعنى هذه الدراسة بموضوع مهم أثار جدلا في مدونات السياسة الشرعية قديما وحديثا وهو (البيعة) كإحـدى طرق اختيار الحاكم في الإسلام. \ وتستمد (البيعة) أهميتها من كونها الأساس والقاسم المشترك في تولية الخلفاء الراشدين والأساس الذي يصـحبه اختيار الحاكم وتنصيبه في الإسلام. \ وتبين الدراسة معنى البيعة لغة واصطلاحا، وكذلك صورة البيعة، وأقسام البيعة (البيعة الخاصـة، والبيعـة العامة). \ وتبين الدراسة آراء العلماء والفقهاء في بيعة أهل الحل والعقد من المسلمين (البيعة الخاصة)، والشروط التي يجب توفرها فيهم، وعددية من تنعقد بهم الإمامة من أهل الحل والعقد. ثم تبين الدراسة معنى البيعة العامـة، والفرق بينها وبين البيعة الخاصة، وأهمية البيعة العامة والآثار المترتبة عليهـا وعلـى بيعـة أهـل الحـل والعقد، كذلك تتناول الدراسة مسألة مهمة أثارت جدلا بين الفقهاء وهي تعدد البيعة أو وحدة الخلافة. This study is concerned with an important topic that sparked a controversy in the records of Islamic politics both in the past and present time. That topic is Bay،a. The \ importance of Bay،a comes from the fact that it is one of the methods for selecting the ruler in Islam. \ Bay،d derives its importance from being the foundation and common denominator in \ the inauguration of the righteous caliphs, and the basis on which a ruler is chosen and inaugurated in Islam. This study shows the meaning of Bay،a both denotatively and \ connotatively, and the way it is executed as well as its types: private or public Bay،a. \ The study also reflects the views of scholars and jurists on the Bay،a of the authorities [private Bay ،a and the conditions that must be met in them and the number of dignitaries in order to constitute the imamate. \ The study also clarifies the meaning of the public allegiance and how it differs from the private Bay،a, and the importance of the public Bay،a and its consequences on the Bay،a of the dignitaries and authoritative sources. \ Moreover, the study addresses an issue that raised a controversy among scholars: the issue of the multiplicity of Bay،a or the unity of caliphate |
