| المستخلص: | إن للناس مقاصد لا تنحصر في معتقداتهم وأعمالهم، وتتعدد هذه المقاصد وتتنوع وتختلف. وفي بناء مقاصد المكلفين المتغيرة على مقاصد الشريعة الثابتة وأدلتها، يأتي ا لتجديد في العمل بالمصالح المعتبرة، فالشارع وضع منظومة مقاصد التشريع جملةً وتفصيلاً، وهذه ثابتةٌ يتجدد الاكتشاف لها والعمل بها، ولمقاصد المكلفين منظومةٌ متغيرة، ومن خلال العلاقة بين المنظومتين تتجلى مظاهر التجديد. يتناول هذا البحث تقاسيم ذات اعتبارات متنوعة للمقاصد الشرعية، ودراسة لطبيعة العلاقة بين المكونات الداخلية للمقاصد الشرعية بعضها ببعض، وتوصيف طبيعتها التفاعلية وعلاقاتها بالبيئة الخارجية المتعلقة بها، وذلك بالنظر إلى جوهرها ومظهرها وتراتيبها ونظامها. People have diverse and divergent objectives that are not exclusively limited to their beliefs and deeds. Through reconciling the evolving and changing objectives of law-bound individuals to the immutably permanent objectives and guidelines of the Shari’a, rejuvenation and reform based on sound interests ensues. The Lawgiver have already laid down the foundations of legislation objectives in totality as well as in detail. These are permanent, immutable but constantly avail itself to rediscovery and implantation. On the other hand, the objectives of law-bound individuals has a changing character. Out of this entwined relationship between these two sets of objectives, the aspects of renewal germinate. This research paper deals with varying considerations of Shari'a objectives and examines the nature of the relationship between its inner components. It, also, delves into its interactive nature and its relationship with relevant outer milieu by examining its essential nature, outward chacter, it's clasification and order. |
