| المستخلص: | في العقود الأخيرة رغم التقدم الطبي والصحي انتشرت أمراض معدية كثيرة, كـان من أخطرها وأسرعها انتشارا وفتكا الأمراض الجنسية، التي لم تجد معها الجهود المبذولة في الحد منها عالميا. وأدى الانفتاح العالمي إلى انتشار هذه الأمراض، لدرجـة جعلـت منظمـة الصحة العالمية تحذر منها، وتقر بعجزها عن الحد منها، ولـذا زادت الإصـابة بهـا علـى الخمسمائة مليون إصابة سنويا, تسبب في انتشارها شيوع الإباحة الجنسية فـي المجتمعـات الغربية والمجتمعات المتأثرة بها، وعدم وضع قوانين تعاقب من تسبب في نقل المرض لغيره, وخاصة مرض الإيدز الذي يتسبب كل عام في وفاة الكثيرين به، فكان نقـل المـرض إلـى الصحيح بمثابة قتله عمدا، وقد جاءت الشريعة الإسلامية بالمحافظـة علـى حقـوق النـاس وحياتهم ومنع التعدي عليها، ووضعت حدودا صيانة لحياتهم من الاعتداء عليهـا، لـذا كـان لزاما على الباحثين دراسة أحكام نقل هذه الأمراض والأحوال التي يتم فيهـا للفصـل فيهـا قضائيا.
