| المستخلص: | يمثل اعتبار المقاصد الشرعية في الفتوى الاعتبار الحالي والمآلي لها، كما مثل النص الشرعي الاعتبار الدلالي لها. وكلما كانت الواقعة بعيدة عن زمن نزول الوحيً؛ احتاجت الفتوى فيها إلى تعضيد بالمقصد المستلهم من النص، وارتباطها به. وقد يتعارض المقصد المعتبر مع ظاهر النص المستنبط منه أو من غيره، كما قد تتعارض المقاصد مع بعضها, ولذا يظهر الاختلاف في نظر المفتي، فلزم ضبط المقاصد وتقييدها عند الاعتداد بها في الفتوى, ولذا كانت هذه الضوابط هي شرط أساس الفتوى وصحتها.
