| المستخلص: | هدفت الدراسة الحالية إلى الكشف عن ماهية حماية حقوق الأشخاص ذوي الإعاقة في القانون الدولي لحقوق الإنسان. حيث تناولت عدة تساؤلات منها ما هي الالتزامات التي على عاتق الدول والمنظمات الدولية تجاه الأشخاص ذوي الإعاقة، وما هي وسائل رصد انتهاكات حقوق الأشخاص ذوي الإعاقة، وأيضا هل توجد ضمانات الممارسة الفعلية لحقوق هذه الفئة. كما أوضحت الصعوبات التي تحول دون التمتع الأشخاص ذوي الإعاقة بحقوقهم المقررة في مواثيق حقوق الإنسان وما هي سبل حلها. وتوصلت النتائج إلى أن أصبحت الدول والمنظمات الدولية والإقليمية تنظر إلى حقوق المعوقين نظرة لا تقل أهمية عن حقوق الأفراد الأصحاء غير أن إعمال حقوق المعوقين يمر بأزمه حقيقية مما يتطلب التدخل الإيجابي من طرف الدولة. وممارسة حقوق المعوقين لا يتحقق إلا في ظل سياسات اقتصادية واجتماعية تقوم على العدالة الاجتماعية. كما تتفاوت مستويات تعزيز وحماية حقوق المعوقين بين منظمة إقليمية وأخري. وأوصت الدراسة بضرورة القيام بإصلاحات اقتصادية واجتماعية حقيقية قائمة على أسس ديمقراطية كوسيلة للقضاء على كافة أشكال التمييز في التمتع بالحقوق المدنية والسياسية والحقوق الاقتصادية والاجتماعية والثقافية.\nكُتب هذا المستخلص من قِبل دار المنظومة 2018 The present study aimed to identify the protection of the rights of people with disabilities in international human rights law. The study addressed several questions, including the obligations of States and international organizations towards people with disabilities, the means of monitoring violations of the rights of people with disabilities, as well as the available guarantees of the effective implementations of the rights of people with disabilities. The study also tackled the difficulties that prevent persons with disabilities from enjoying their authorized rights under the umbrella of human rights laws and the ways of solving them. The results have confirmed that States and international and regional organizations regard the rights of people with disabilities as no less important than the rights of healthy individuals. However, applying the rights of people with disabilities is in real crisis and requires positive intervention by the State. The application of the rights of people with disabilities can be achieved only under economic and social policies based on social justice. The levels of promotion and protection of the rights of people with disabilities vary between regional organization and other organization. The study shed light on the need for conducting genuine economic and social reforms based on democratic foundations as a means of eliminating all forms of discrimination in having civil, political, economic, social and cultural rights.\nThis abstract translated by Dar AlMandumah Inc. 2018 |
